The public hearing was held February 9 and the conditio~a~ use committe~ has met and they recommended to approve the condltlonal use permlt for ten years. Landis made a motion and Hartman seconded to approve the conditional use permit for communi~ations Systems Development Inc. for 10 years and approve Resolutlon # 98-0009. Arnold, Hartman, Jeffries Lancaster L~ndis, Logan and Stelk all voted yes and none v;ted no. M;tion carried. - I j f RESOLUTION # c; t- () 00 c; A RESOLUTION GRANTING THE APPLICATION FOR A CONDITIONAL USE OF A TRACT OF LAND IN THE SOUTHEAST QUARTER (SE ~) OF THE SOUTHEAST QUARTER (SE ~) OF SECTION TWENTY-ONE (21), TOWNSIDP TEN (10) NORTH, RANGE TEN (10) WEST OF THE 6th P.M., HALL COUNTY, NEBRASKA. WHEREAS, Communication Systems Development, hereinafter referred to as applicant, is the lessee of a tract of land In The Southeast Quarter (Se ~) Of The Southeast Quarter (Se ~) Of Section Twenty-One (21), Township Ten (10) North, Range Ten (10) West Of The 6th P.M., Hall County, Nebraska, and informally described as a tract of land with dimensions of one hundred feet (100') by one hundred feet (100') in the southwest comer of the aforesaid Quarter Quarter adjacent to the county road right of ways, the exact location and dimensions thereof to be determined by subsequent survey; WHEREAS, applicant has made its written application for a permit to use the above- described property for the erection, operation, and maintenance of a microwave and radio telecommunications tower; and WHEREAS, said property is located within the AG-l Agricultural Zoning District; and WHEREAS, on February 9, 1999, a public hearing was held upon said application by the Hall County Board of Supervisors following due and proper notice of the same to the public; and WHEREAS, the Hall County Board of Supervisors is empowered pursuant to the Hall County Zoning Resolution to grant an application for conditional use upon a determination that the proposed use is consistent with the intent of the AG-l Agricultural Zoning District. NOW, THEREFORE, BE IT RESOLVED that, upon consideration of the evidence presented ~d the factors to be considered pursuant to subsection d. of section 11 of the Hall County Zoning Resolution, the use of the aforesaid property for the erection, operation and maintenance of a microwave and radio telecommunications tower is found to be consistent with the intent of the AG-l Agricultural Zoning District and that the application for conditional use is hereby granted subject to the following conditions, limitations, and restriction: 1. All waste, rubbish and debris, if any, must be completely cleared from the above described real estate as soon as practical and said real estate must, at all times, be kept in a clean and neat condition.
