~~-^~~ ~~.a~~ <br />SUBDIVISION AGREEMENT <br />CONESTOGA MALL .THIRD SUBDIVISION <br />In the City of Grand Island, Nebraska <br />The undersigned, W. R. C. Properties, Inc., a Delaware corporation, <br />hereinafter called the Subdivider, as owner of a tract of land comprising <br />all of Conestoga Mall Second Subdivision, situated in part of the East <br />' Half of the Southeast Quarter (E~SE4) of Section Twelve (12), Township <br />Eleven (11) North, Range Ten (10) West of the 6th P.M., in the City of <br />Grand Island, Hall County, Nebraska, said tract containing 52.760 acres, <br />more or less; desires to have subdivided as a subdivision the above- <br />described tract of land which is located within the corporate limits of <br />the City of Grand Island, Nebraska, and hereby submits to the City Council <br />of such City for acceptance as provided by law an accurate map and plat - <br />of such proposed subdivision to be known. as Conestoga Mall Third Sub- <br />division, designating explicitly the land to be laid out and particularly <br />describing the location of proposed additions and easements belonging to <br />such subdivision, with easements designated by dimensions, and proposes <br />to cause the plat of such subdivision when finally approved by the Regiona3 <br />Planning Commission and the City Council to be acknowledged by such owner, <br />certified as to accuracy of survey by a registered land surveyor, and to = <br />cvntair~ a dedication of easements to the use of public utilities. In <br />consideration of the acceptance of the plat of Conestoga h1a11 Third Sub= <br />--- <br />division, the Subdivider hereby consents and agrees-with the iity of _-- <br />Grand Island, Nebraska, that it will install or provide at its expense <br />the following improvements. <br />1. Commercial Development. The proposed subdivision constitutes a <br />planned unit development, pursuant to Section 36-25 of the Grand Island <br />City Code. For that reason, the Subdividers agree that the continuing <br />requirements of Section 36-25 of the Grand Island City Code pertaining <br />to commercial development under the planned unit development will be <br />complied with by the Subdividers. <br />:. <br />2. dater artd Sat-itary Sewer.
