<br />proposed additions as a result of the Conestoga Mall Third Subdivision <br />to connect to said private service mains for both water and sanitary <br />sewer service, the sanitary sewer service main being located on the west <br />edge of Webb Road. The Subdivider agrees that all proposed additions <br />to the Conestoga Mall as a result of the platting of Conestoga Mall Third <br />Subdivision shall connect to said City water and sanitary sewer service <br />mains via the private service lines to said mall, <br />3. Drainage. The Subdivider agrees to continue to grade the <br />property so that storm water drainage is directed to public right-of-way <br />and thereby to the public storm sewer system. <br />4. Streets. The Subdivider further agrees to waive any protests <br />to repaving of Webb Road where it abuts said subdivision.- <br />5. Warranty. The undersigned owner, as Subdivider, warrants that <br />it is the owner in fee simple of the land described and proposed to be <br />known as Conestoga Malt Third Subdivision, and-that an abstract of title <br />willlbe submitted for examination, if necessary, upon request of the <br />City of Grand Island. <br />6. This agreement shall run with the land and shall be binding upon <br />and inure to the benefit of the parties hereto, their successors, assigns, <br />heirs:, devisees, and legatees.
