proposed additions as a result of the Conestoga Mall Third Subdivision to connect to said private service mains for both water and sanitary sewer service, the sanitary sewer service main being located on the west edge of Webb Road. The Subdivider agrees that all proposed additions to the Conestoga Mall as a result of the platting of Conestoga Mall Third Subdivision shall connect to said City water and sanitary sewer service mains via the private service lines to said mall, 3. Drainage. The Subdivider agrees to continue to grade the property so that storm water drainage is directed to public right-of-way and thereby to the public storm sewer system. 4. Streets. The Subdivider further agrees to waive any protests to repaving of Webb Road where it abuts said subdivision.- 5. Warranty. The undersigned owner, as Subdivider, warrants that it is the owner in fee simple of the land described and proposed to be known as Conestoga Malt Third Subdivision, and-that an abstract of title willlbe submitted for examination, if necessary, upon request of the City of Grand Island. 6. This agreement shall run with the land and shall be binding upon and inure to the benefit of the parties hereto, their successors, assigns, heirs:, devisees, and legatees.
