<br />WATER EASEMENT
<br />NEBRASKA CROSS - COUNTIES GIRL SCOUT COUNCIL, INC., now known as GOLDENROD
<br />GIRL SCOUT COUNCIL, INC., herein called the Grantor, in consideration of
<br />_Five Hundred Ninety Two Dollars and Fifty Cents U592.50) receipt of which
<br />is hereby acknowledged; and in further consideration of the right to tap the
<br />water transmission line with a service line for potable water use, without
<br />payment of tap fee or assessment, hereby grants and conveys unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation in Hall County, Nebraska, herein called the Grantee, a
<br />permanent and perpetual easement and right -of -way to survey, construct,
<br />reconstruct, relocate, inspect, repair, replace, extend, add to, maintain,
<br />operate, and remove thereon, a water transmission pipe line, equipment, and
<br />other appurtenances connected therewith, along, across, underneath, and
<br />through a sixteen (16.0) foot wide tract of land located in Lot Four (4) and
<br />accreted land thereto, Section Eleven (11), Township Ten (10) North, Range
<br />Nine (9) West of the 6th P.M., Hall County, Nebraska; the centerline of the
<br />easement tract being more particularly described as follows:
<br />Beginning at a point on the Easterly line of Lot Four (4),
<br />Section Eleven (11), Township Ten (10) North, Range Nine (9)
<br />West, said point being fifteen (15.0) feet South of the North
<br />line of said Lot Four (4); thence Westerly parallel to the
<br />North line of said Lot Four (4), to a point one thousand
<br />thirty eight and eight - tenths (1,038.8) feet East of the
<br />Northwest corner of said Section Eleven (11); thence
<br />deflecting left, and running Southwesterly a distance of
<br />three hundred ninety five (395.0) feet, to a point twenty
<br />u.
<br />eight (28.0) feet South of the North line of said Lot Four
<br />(4), and six hundred forty four (644.0) feet East of the
<br />Northwest corner of said Section Eleven (11); thence Westerly
<br />parallel to the North line of said Lot Four (4) to the
<br />Westerly line of said Lot Four (4);
<br />And a sixteen (16.0) foot wide easement with the centerline
<br />extended East of the above said point of beginning, across
<br />any accreted land lying Easterly of Lot Four (4), said
<br />Section Eleven (11).
<br />The above said easement containing 0.375 acres, more or less,
<br />as shown on the plat dated 6/13/86, marked Exhibit "A ",
<br />attached hereto, and incorporated herein by reference,
<br />together with the following rights:
<br />1. Grantee shall have the right of ingress and egress across Grantor's
<br />property for any purpose necessary in connection with the survey,
<br />construction, reconstruction, relocation, inspection, repair, replacement,
<br />extension, addition to, maintenance, operation, and removal of said water
<br />transmission pipe line. Such ingress and egress shall be exercised in a
<br />reasonable manner.
