<br />2. The Grantee covenants and agrees with the Grantor that it will
<br />defend, protect, save harmless, and indemnify the Grantor from and against all
<br />liability, loss, damage, claims, and expense suffered by or imposed on the
<br />Grantor, by reason of the survey, construction, reconstruction, relocation,
<br />inspecting, repairing, replacing, extending, adding to, maintaining,
<br />operating, and removing the water transmission line by the Grantee.
<br />3. Grantee shall have the right to trim, clear, or remove all trees and
<br />brush on said right -of -way as may be necessary to efficiently survey,
<br />construct, reconstruct, relocate, inspect, repair, replace, extend, add to,
<br />maintain, operate, and remove said water transmission pipe line. All refuse
<br />from such tree cutting or trimming shall be removed by Grantee.
<br />4. Grantee hereby agrees to pay the Grantor or Lessee, as their
<br />interest may appear, for any damage to real or personal property, fences,
<br />livestock, and to growing crops by reason of the survey, construction,
<br />reconstruction, relocation, inspection, repair, replacement, extension,
<br />addition to, maintenance, operation, and removal of said water transmission
<br />pipe line. The Grantee or its contractor shall restore the surface of the
<br />easement and the existing access road, as nearly as possible to the grade and
<br />condition as it existed immediately prior to construction, reconstruction,
<br />relocation, inspecting, repairing, replacing, extending, adding to,
<br />maintaining, operating, and removing of said water transmission pipe line.
<br />All such work will be exercised in a reasonable manner, and so as not to
<br />interfere with Grantor's access to any part of its property.
<br />5. Grantor or Lessee, as their interest may appear, may cultivate, use,
<br />and enjoy the land within the right -of -way; provided, that such use shall not,
<br />in the judgment of Grantee, endanger or be a hazard to or interfere with the
<br />survey, construction, reconstruction, relocation, inspection, repair,
<br />replacement, extension, addition to, maintenance, operation, and removal of
<br />said water transmission pipe line; and provided further, that Grantor shall
<br />not allow any buildings, structures, or storage of combustible material or
<br />property to be placed upon the above described easement area. Grantee agrees
<br />that the use of the area subject to the easement as a road will not endanger,
<br />be a hazard to, or interfere with any of the rights granted to the Grantee in
<br />this Easement.
<br />6. Grantee shall have the right, at any time, to relocate or add water
<br />transmission pipe line, equipment, or other appurtenances connected therewith.
