Eggers, Attorney at Law, Successor Trustee, <br />upon the Deed of Trust made and entered into on or about March 30, <br />19B4, by and between Ronald C. Cornelius and Tammy R. Cornelius, <br />husband and wife, Trustors, and Jon F. Luebs, Trustee, and Five <br />Points Bank, Beneficiary, which Deed of Trust was recorded on <br />March 30, 19B4 as Instrument No. 84-00l666 in the Office of the <br />Register of Deeds of Hall County, Nebraska, herein called the <br />Grantor, in consideration of Thirty Thousand six Hund~ed Dollars <br />($30,600.00), and other valuable consideration, received from <br />Grantee, does hereby grant, bargain, sell, convey and confirm unto <br />Nebraska Investment Finance Authority, successor in interest to <br />Nebraska Mortgage Finance Fund, herein called the Grantee, the <br />following described real property in Hall County, Nebraska: <br /> <br />NOV 28 1988 <br />1$7~J1I <br /> <br />Lot One (1), Dahlke Subdivision, to the City <br />of Grand Island, Hall County, Nebraska <br /> <br />to have and to hold the above described premises together with all <br />tenements, hereditaments and appurtenances thereto belonging unto <br />the Grantee and to Grantee's heirs and assigns forever. <br /> <br />And the Grantor does hereby covenant with the Grantee and <br />with the Grantee's heirs and assigns as follows: <br /> <br />1. That on July 2B, 198B, Nebraska Investment <br />Finance Authority, successor in interest to the <br />Nebraska Mortgage Finance Fund, beneficiary of <br />the aforementioned Deed of Trust, appointed <br />Ronald L. Eggers as Successor Trustee, which <br />Substitution of Trustee was recorded on August <br />lO, 19BB as Instrument No. BB-104371 in the <br />Office of the Register of Deeds of Hall County, <br />Nebraska. John F. Luebs, the original Trustee, <br />did, on August 2, 1988, execute an Acknowledg- <br />ment that he received a copy of said Substitu- <br />tion of Trustee. Said Acknowledgment was <br />recorded on August 10, 198B in the Office of <br />the Register of Deeds of Hall County, Nebraska, <br />and appears as Instrument No. BB-10437l. A copy <br />of the Substitution of Trustee and Acknowledg- <br />ment was served upon the Trustors, Ronald C. <br />Cornelius and Tammy R. Cornelius, husband and <br />wife, on or about August B, 198B, by certified <br />mail, return receipt requested, postage prepaid. <br /> <br />2. That there occurred a breach of the obliga- <br />tions of the Trustors for whic~ the trust <br />property was conveyed as security, to-wit, <br />that Trustors failed to pay the Beneficiary <br />payment~ which wer~ contractually due, and the <br />Grantor, at the request of the Successor Bene- <br />ficiary, elected to declare the entire unpaid <br />principal balance, together with interest <br />thereon, at once and immediately due and payable. <br /> <br />3. That a Notice of Default was filed by the <br />Successor Trustee on August 10, 19BB, as <br />Instrument No. 8B-104372 in the Office of the <br />RE!gister of Deeds of Hall County, Nebraska. A <br />copy of the Notice of Default was served upon <br />the Trustors by certified mail, postage prepaid, <br />return receipt requested, on or about August 16, <br />19B8. <br /> <br />4. The Successor Trustee published Notice of the <br />Trustees' Sale, which sale was held on November <br />16, 19BB, at 9:00 a.m. on the lower level lobby <br />
