COUNTY OF HALL ) The undersigned Affiant, upon being first duly sworn upon oath, does hereby depose and state as follows: 1. This Affidavit is pursuant to the authority granted by Nebraska Probate Code § 30- 24,129, 2. Carolyn B. Lockwood is the owner of record of the following described real estate situated in Grand Island, Hall County, Nebraska, to wit: North Seventy and Seven - tenths (N70.7) feet of Lots One (1) and Two (2). in Block Thirteen (13); in Fairview Park. Addition to the City of Grand Island, Hall County, Nebraska, as surveyed, platted and recorded. 3. Carolyn B. Lockwood died on September 18, 2003. The real estate herein described was originally acquired by Carolyn B. Lockwood and her spouse, R. B. Lockwood, pursuant to Sheriff's Deed dated December 20, 1956 and filed for record April 24, 1957 in the office of the Register of Deeds of Hall County, Nebraska at Book 120 of Deeds, page 599. 4. R. B. Lockwood died June 28, 1986, and by virtue of joint tenancy ownership, the property passed to Carolyn B. Lockwood, his surviving spouse, free and clear of any liens for Nebraska Inheritance Tax or Federal Estate Tax. 5. The undersigned Affiant, Steven D. Lockwood, is the adult son of R. B. Lockwood and Carolyn B. Lockwood, and claims an interest as successor to the decedent's interest in the real estate. At death, Carolyn B. Lockwood was survived by two children (her only issue) namely Steven B. Lockwood and Karen K. Williams. These same two individuals are the sole issue of both R. B. Lockwood and Carolyn B. Lockwood. Affiant intends to convey property to Steven Lockwood and Karen K. Williams, as tenants in common, as successors to the interest of Carolyn B. Lockwood, deceased. 6. Pursuant to Neb. Rev. Stat. § 30- 24,129, the undersigned Affiant states as follows: (1) The value of the decedent's interest in all real property in the decedent's name on the date of her death does not exceed $25,000.00. According to records maintained by the Hall County Assessor, the value of the real estate described herein is $449.00. (2) Thirty days have elapsed since the date of death of Carolyn B. Lockwood, as shown by the attached certified copy of the decedent's death certificate. (3) No application or petition for the appointment of a personal representative is pending or has been granted in any jurisdiction. The only estate proceedings commenced dealing with the estate of Carolyn B. Lockwood was an inheritance tax determination in Hall County, Nebraska. The inheritance taxes have been determined, paid, and receipt evidencing payment filed of record.
