, . <br />; „ <br />2411093i4 <br />Lot One (1), Lake Heritage Subdivision, an addition to the City of Grand <br />Island, Nebraska, along with any subsequent resubdivision thereof; and <br />Lots One (1), Two (2), Three (3), Four (4), Five (5) and Outlot A <br />in Lake Heritage Second Subdivision, an addition to the City of Grand <br />Island, Nebraska, along with any subsequent resubdivision thereof. <br />3. Every Owner of a Lot within the Property shall be a member of the Association. <br />Membership in the Association is a condition of ownership of any Lot within the Property. <br />Membership shall be appurtenant to and may not be separated from ownership of any Lot that is <br />subject to assessment. The Association shall have one class of voting membership that shall be <br />and include the Owner of each Lot contained in the Properiy. When more than one (1) person <br />holds an interest in any Lot contained within the Property, all such persons shall be members of <br />the Association but any vote for such Lot shall be exercised as they among themselves drtermine <br />with no more than one (1) vote being cast with respect to any Lot. Voting privileges are <br />restricted to paid-up members only. <br />4. Each Owner of any Lot contained within the Properiy agrees to this <br />DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS <br />by acceptance of any conveyance of any Lot, or any portion thereof, including subsequent lots <br />created by a subsequent resubdivision of these current lots whether or not it is so expressed in <br />any such conveyance. <br />B. Lot Restrictions <br />1. All Lots within the Property shall be known and described as residential for one <br />dwelling to be used for occupancy by not more than one family and a private gaxage for not more <br />than three cars and one outbuilding. No commercial or business enterprise shall be conducted or <br />operated within the Property. <br />2. All garages must accommodate at least two caxs and must be attached <br />directly to the dwelling or connected thereto by breezeway or similar structure. Any <br />outbuilding shall be the same quality and material or construction as the outside finish <br />and roof of the residential structure and shall be no larger than one thousand square feet (1,000 <br />sq./ft.) of floor space unless the Owner obtains the prior written approval of the Association. No <br />building or dwelling house shall be moved onto any Lot. No trailer, tent, garage, shack or other <br />unsightly outbuilding shall be used on any Lot or part thereof, nor used as a temporary residence. <br />3. No barns, chicken houses, house trailers, commercial work or sales <br />shops, or other buildings for the care and housing of fowl, rabbits or livestock shall <br />be placed, maintained or used on any residential lot nor shall any fowl, rabbits or animals <br />other than household pets be kept upon any lot and household pets shall not be kept, bred <br />or maintained for any commercial purposes, or allowed to run at large. <br />4.
