Occupancy.Baaower shall occupy, esta.blisb, and use tiie Property as $orrower's principal residence <br />within 60 days af�er the execution of this Secarity Instruraent and shall continue to occupy the Property as <br />Boaower's principal residence for at least one year after the da.te of occupancy, unless Lender otherFVi.se <br />agreees ia writing, which consent shall not be unreasonably �vithheld, or unless extenuating circumstances <br />exist which are beyond Borrower's control. <br />7. Preservation,Maintenanceand Protectionof the Properly; Inspections.Bozrower shall not destroy, <br />damage or impair the Properiy, a11ow the Property to deteriorate or commit �vaste on tlie Property. Whether <br />or not Boaower is residi.ng in the Properry, Boaower sha11 maiatain the Property in order to prevent the <br />Property from deteriora.ting or decreasi.ng iu value duc to its condition. Unless it is determined pursuant to <br />Section 5 that repair or restoration is not economically feasible, Borrowez shall promptly repair the Property <br />if damaged to avoid further deterioration or damage. If �n��*%��ce or condemnaxion proceeds are paid in <br />connection with damage to, or the taking o� the Properly, Bozrower shaIl be responsible for repairiag or <br />restoring the Properry only if Lender has released proceeds for such purposes. Lender may disburse proceeds <br />for the regairs and restoration in a single payment or in a series of progress payments as the work is <br />completed. If the inc� or condemnation proceeds are not sufficient to repair or restore the Properiy, <br />Boao�ver is not relieved of Boaower's obligati.on for the completion of such repair or restoraiion. <br />Lender or its agent ma.p make reasonable entries upon and inspections of the Property. If it has reasonable <br />cause, Lender ma.y inspect the interior of the improvemerns on the Properry. Lender shall give Boaower <br />notice at the time of or prior to snch an iaterior inspection specifyin.g such reasonable cause. <br />8. Borrowers LoanApplication.Boaower shall be in default i� during the Loan applicationprocess, <br />$orrower or any persons or entities acting at the direction of Borrower or with Boirower's knowledge or <br />consent gave materially false, misleading, or inaccurate information or statements to Lender (or failed to <br />provide Lender with material information) in connection with the Loan. Material representations include, but <br />are not limited to, representations concemin.g Borrower's occupancy of the Property as Borrower's principal <br />residence. <br />9. Proteationof Lender'sinterest in the Propertyand RightsUnderthts S�cuHty(nstrument.If(a) <br />Bosower fails to perfoim the covenants aad agreements contaiaed ia this Seeurity Instromeat, (b) there is a <br />Iega.l proceeding that might significantly affect Lender's interest in the Property and/or rights under this <br />Security Instivment (sneh as a proceeding in bankruptcy, probate, for condemnation or forfeitare, for <br />enforcement of a lien which may attain. priority over 1�►is Security Inshvment or to enforce laws or <br />regnlations), or (c) Borrower has abandoned the Properiy, then Lender may do and pay for whatever is <br />reasonable or appropriate to protect Lender's interest in the Property and rights an.der this Security <br />Ins�vment, including protecting aud/or assessi.ng the valne of the Properly, and securing and/or repairing <br />the Property. Lender's actions can include, but are not limited to: (a) paying any sums seciued by a lien <br />which has prioriry over this Security Instrument; (b) appearing in court; and (c) paying reasonable attomeys' <br />fees to protect its interest in the Property and/or rights under this Security Instrumen� including its secnred <br />position in a banl�uptcy proceeding. 5ecuriag the Property includes, but is not limited to, entering the <br />Property to make repairs, change locks, replace or board up doors and windows, dra.in wat�rr from pipes. <br />eliminate building or other code violations or dangerous conditions, and have utilities ttuned on or off. <br />Although Lender may take action under this Section 9, Lender does not have to do so and is not nnder any <br />duty or obligation to do so.
