201109037 <br />(a) Any sach agreements will not affect the amounts that Borrower has agreed to pay for Mortgage <br />Insnrance, or any ot6er terms of fhe Loan. Snch agreementc will not 9ncrease the amount <br />Borrower will owe for Mortgage Iasurance, and they w9ll not eniitla Borrower to any refand. <br />(b) Any sach agreements will not affect the rights Borrower has - if any - with respect to the <br />Mortgage Iusurance under the Homeowaers Proteci3oa Act of 1998 or any other law. T'hese rights <br />may inclnde the right to receioe certain dfsclosnres, to request and obtain cancellation of the <br />Mortgage Insurance, to have the Mortga;e Insurance terminated antomaticalIy, and/or to receive <br />a refand vf anv Mortgage Insurance preminms that were unearned at the time of such <br />cancelTation or termination. <br />11. Assignmentof MiscellaneousProeeeds;Forteiture,A11 Miscellaneous Proceeds are hereby assigned to <br />aad shall be paid to Lender. <br />If the Property is damaged, such MisceIlaneous Proceeds shall be applied to restoration or repair of the <br />Property, if the restor�tion or repair is economically feasible aud Lender's security is not lessened. Daring <br />such repair and restoration period, Lender shalI have the right to hold such Miscellaneous Proceeds until <br />Lender has had an opportunity to inspect such Properiy to ensure the work has been completed to Lende�s <br />satisfaction, provided that such inspection shall be undertaken promptly. Lender may pay for the repairs aud <br />restoration m a single disbursement or in a series of progress payments as t11e work is completed. Unless an <br />ageement is made in writing or Applicable Law requires in.terest to be paid on snch Miscellaneous Proceeds, <br />Lender shall not be required to pay Boaower aay interest or earnings on such Miscellaneous Proceeds. If the <br />restoration or repair is not economically feasible or Lender's security would be lessened, the Miscellaneous <br />Proceeds shall be applied to the sums secured by this Security Instrument, whether or not then du�, with the <br />excess, if any, paid to Bonrower.
