FARM LEASE AGREEMENT <br /> � 98- 1t�2'712 <br /> This Farm Lease Agreement is entered into by and between <br /> Jeanne K. Whitefoot, Trustee of The Jeanne K. Whitefoot Trust <br /> created by the Revocable Living Trust Agreement dated February 7, <br /> 1994, OWNER, and Douglas McTavish and Keith McTavish, TENANT. <br /> 1. THE PROPERTY. The property which is the subject of this <br /> Agreement is legally described as follows : <br /> The Southwest Quarter (SW 1/4) of Section Thirty-one <br /> (31) , Township Eleven (11� North, Range �leven (11) <br /> West of the 6th P.M. in Hall County, Nebraska, <br /> excepting therefrom that part thereof conveyed <br /> to the County of Hall, State of Nebraska, by <br /> Deed recorded in Book 79 at page 610 of the Deed <br /> Records of Hall County, Nebraska; <br /> and <br /> North Half of the Southeast Quarter (N 1/2 SE 14) and <br /> the West Thirty (30) acres of the Southwest Quarter <br /> of the Southeast Quarter (SW 1/4 SE 1/4) in 5ection <br /> Twenty-eight (28) , Township Ten (10) North, Range <br /> Twelve (12) West of the 6th P.M, in Hall County, <br /> Nebraska. <br /> 2 . AGREEMENT TO LEASE. The Owner agrees to lease to Tenant and <br /> Tenant agrees to lease from Owner the property for the term and <br /> consideration hereinafter named: <br /> 2. 1 TERM. The property is hereby leased by the Owner to the <br /> Tenant for a term from March 1, 1998 to February 28, 1999. <br /> 2. 2 RENT. The Tenant agrees to pay as rentals for the term <br /> One-third ( 1J3) crop share of all crops which is the Owner ' s crop <br /> share. The share of any crop payable to Owner as rent shall, <br /> before delivery to Owner, be harvested, combined and shelled for <br /> market by Tenant, at Tenant ' s own costs and expense in accordance <br /> with the best practices known to the farming industry in Hall <br /> County, Nebraska. The Owner ' s share shall immediately after <br /> harvest be delivered to the Owner at such place in the Grand Island <br /> area as directed by the Owner. The Owner' s share of corn delivered <br /> to an elevator at the Owner 's direction must be 15� or below in <br /> moisture content. If the moisture content of the corn is more than <br /> 15�, the Tenant must absorb the expense for the high moisture <br /> content in excess of 15�. <br /> 1 � <br />
