. , 98-1�2szs <br /> or electrical lines shall not cross any active railroad track or come within 25 feet of such track <br /> without Grantor's prior written consent). <br /> This Easement shall be permanent and exclusive, shall run with the land, and shall <br /> be binding upon the parties hereto and their successors and assignees, except that the <br /> Easement shall terminate automatically in the event that no outdoor advertising facility has <br /> been present on the Premises, in functional condition,capable of being used for advertising, <br /> for twelve consecutive months. <br /> The boundaries of this Easement more particularly described as follows: <br /> a. a one foot envelope on the land for any supports, poles, wires or other apparatus <br /> anchored on or in the ground to support and/or elevate any outdoor advertising <br /> facility structure;and <br />, b. a three foot envelope of airspace for the entire facing and backing of any outdoor <br /> advertising facility structure; <br /> provided,however,either of said envelopes shall be reduced or eliminated to the extent such <br /> envelope comes within fifteen (15) feet of the nearest rail of any active railroad track. Said <br /> signboard being generally located on said attached Exhabit"A". <br /> RESERVING, however, unto Grantor, its successors and assignees, the right and <br /> privilege to use, license, lease, permit and/or sell all or any portion of the Premises for any <br /> and all purposes not materially inconsistent with Grantee's use of this Easement for the <br /> purposes and on the conditions set forth herein; provided however, that any sale of all or <br /> any portion of the premises shall be subject to this Easement. <br /> This Easement is made subject to the following express conditions: <br /> 1. Any and all existing and future interests in, and encumbrances upon, the <br /> Premises, including but not limited to pipelines, wire lines or fiber optic <br /> communication lines or equipment on the Premises (whether in the airspace, on <br /> the surface or under the surface of the Premises). <br /> 2. Any and All excavations and/or improvements constructed or removed by <br /> Grantee in the course of activities permitted by the terms of this Easement shall <br /> be made and maintained in such manner, form and extent as will provide <br /> adequate drainage of and from the Premises and all land near the Premises, and <br /> shall not interfere in any way with the use or value of any property or use rights <br /> of Grantor or any party to whom Grantor has granted or will grant ownership <br /> rights or use rights. <br /> 3. No outdoor advertising facilities may be constructed, modified or replaced <br /> without prior written approval of Grantor.
