As used in this Section 21: (a) "Hazardous Substances" are those <br />substances defined as toxic or haaardous substances, po!lutants, or wastes by Environmental Law and <br />the foNowing substances: gasaline, kerasene, other flammable or taxic petroleum products, toxic <br />pesticides artd herbtcic�es, volatife solvents. materials cantaining asbestas or formaldehyde, and <br />radioactive materials; (b) °Environmentaf Lav� means federal lainrs and faws of the jurisdictiort where the <br />Property is tocated that relate tQ health, safety or envirc�mentaf p�tection; f c) "Environmecr#a! Cteanup° <br />incfud+es any response action, remediat action, or removal action, as defined in Environmental Law; and <br />(d) an "Environrnental CondiFtion" means a condition that can cause�, co�fibute to, or othervvise t�igger ar� <br />Environmental Cleanup. <br />Borrower shaft not cause or permit the presence, use, disposal, storage, or release of any <br />Hazardous Substances, or threaten to release any Hazardous Substances, ort pr in the Property. <br />B�rower shall not do, nw allovv a�yone etse to do, anything affeeting the Property (a} that is in vivlation of <br />any Environmental Law, (b) which creates an Environmental Condfion, or (c) which, due to the presertce, <br />use, or release of a Hazardous Substance, c�eates a condition t�at adversety afFects the value of the <br />Property. The preceding two senteness shall not apply to the presence, use, or sfiorage on the Praperty <br />of small quantil�ies of Hazarrd€fus Substartces that are generally recognized ta be appropriate to normal <br />residential uses and to mai�tenanse o� the Prapert� f inel�ding, but Ftot limited to, k�azardous s�bstances <br />in cansumer products). <br />�urrower shaq prompfly give I�ender written notice of (aj any investigation, claim, demand, lawsuit <br />or other action by any gQVemmental Qr regulatory agency or private party invoiving the Property and any <br />Hazardous Substance or E�tviranmental Law of whic� Bc�rrc�wer has actaal knowledge, (b) any <br />Environmentat Condition, including but net limited ta, any spiBing, leaking, discharge, release or threat of <br />release of any Hazardous Substance, and (c) any canditiort caused by the presence, use or release of a <br />Hazardous Substance arhich adversely affeds the vaiue o# the Property. lf Borrowrer leams, ar is notified <br />by any govemmental or regulatory authority, or arry private party, that any removaf or other rerrr�eediatiort of <br />any Hazardous Subsfianc� af�ting the Property is nec�ssary, �orrovver shall promptly take a!I necessary <br />remediat actions in ac.cordance wittt Envirortmerrtaf Lawr.
