�01�07�49 <br />2. Amendments. <br />2.1. Note. The "Note" as defined in the Mortgage and Assignment of Rents shall mean <br />and refer to the Promissory Note dated September 28, 2011, in the original principal amount <br />of $929,246.13, from Grantor to Lender, together with all renewals of, extensions of, <br />modifications of, refinancings of, consolidations of, and substitutions for such promissory <br />note. The foregoing Promissory Note is a modification of and substitution for the <br />promissory note referenced in the original Mortgage and Assignment of Rents. <br />2.2. Maturity Date. The maturity date of the Mortgage is hereby amended to be <br />September 28, 2016. <br />3. Authority; Binding Obligation. Grantor hereby represents and warrants that: (a) the <br />execution, delivery and performance by Grantor of this Modification have been duly authorized; <br />(b) this Modification has been duly executed and delivered by Grantor and constitutes the legal, <br />valid and binding obligation of Grantor enforceable against it in accordance with the terms <br />hereof; (c) Grantor is not in default under the Mortgage, the Assignment of Rents or any Related <br />Documents to which it is a party and no such default has occurred prior to the date hereof; and <br />(d) Grantor hereby ratifies and reaffirms all of its obligations under the Mortgage, the <br />Assignment of Rents and all Related Documents. <br />4. Effect. The Mortgage and Assignment of Rents shall remain in full force and effect as <br />amended by this Modification and in all other respects shall remain unchanged. <br />5. Invalidity. If any provision of this Modification is invalid, illegal or unenforceable, the <br />remaining provisions shall not be affected or impaired thereby and there shall be substituted for <br />the invalid, illegal, or unenforceable provision the most similar provision that is valid, legal and <br />enforceable. <br />6. Governing Law. This Modification sha11 be governed by and construed in accordance with <br />the laws of the State of Nebraska. <br />(Remainder of Page Intentionally Left Blank.) <br />2 <br />
