<br />THAT WHEREAS, under the Nebraska Trust Deeds Act, Neb Rev. Sta.t 76-1001
<br />to 76-1018, a Trust Deed was executed by Robert Paul Baker Jr. and Christina. Baker
<br />("Trustors") to Sam Grimminger, as trustee ("Trustee"), ior the benefit of The Edna M.
<br />Crow Revocable Trust, the beneficiary named therein ("Beneficiary"), recorded on the
<br />llth day of February, 2010 in the office of the Register of Deeds of Ha11 County,
<br />Nebraska as Instrument No. 201000945; and
<br />WHEREAS, Trustee filed for record in the office of the Register of Deeds of Hall
<br />County, Nebraska, a Notice of Default, identifying the Trust Deed by sta.ting the name of
<br />the Trustors named therein and giving the Instrument Number where the same, was
<br />recorded, a description of the Trust property, and said Notice ,containing a sta,tement that
<br />a breach of an obligation for which the Trust property was conveyed as security had
<br />occurred, and setting forth the nature of such breach and,of.the Truste�'s election to sell.
<br />or cause to be sold such property to satisfy the obligation; and
<br />WHEREAS, after the lapse of not less than one month, the breach or default was
<br />not cured as required by law; and
<br />WHEREAS, the Trustee gave written notice of the time and place of sale
<br />particularly describing the property to be sold by publication of said notice at least five
<br />(5) times, once a week for five (5) consecutive weeks, the last publication being at least
<br />ten (10) days but not more than thirty (30) days prior to the sa1e, in a newspaper having
<br />gene�al circulation in Hall �County, Nebraska, all aceordina to the Neb.r�.sk.a Trust Deeds
<br />Act; and
<br />WHEREAS, the sale was held at the time and place designated in the Notice of
<br />Sale which was between the hours of 9:00 a.m. and 5:00 p.m., and was held at the
<br />Courthouse of the county in which the property to be sold was situated; and
<br />WHEREAS, the Notice of Sale was in substantially the form as provided by the
<br />Nebraska Trust Deeds Act; and
<br />WHEREAS, on the date and at the time and place designated in the Notice of
<br />Sa1e, to wit: the 10�` day of May, 2011 at 10:00 a.m. and after holding the sale open, the
<br />Trustee sold fihe property at public auction to The Edna M. Crow Revocable Trust who
<br />was the highest bidder, said bid being the sum of One Hundred Fifteen Thousand and
<br />no/100 dollars ($115,000.00);
