20110411G <br />f. He will keep ths said premises in as good arder and condition as they <br />are now and wilE not cammit or permit any waste fihereof, reasonable wear and <br />tear excepted, and in the evenf of the failure of the Trustor to keep the <br />buildings on said premises and fihose to be erected on said premises, or <br />Improvements therean, in gaod repair, the Beneficiary may make such repairs <br />as in the Bene�ciary's discretion it may deem necessary for the proper <br />preservation thereof, and any sums paid far such repairs shall bear Interest <br />from the date of payrnent at the rate specifsed in the note, shail be due and <br />payable on demand and shail be ful{y secured by this Deed of Trust. <br />g. He will nat without the priorwritten consent of the Benefic9ary voluntarily <br />create or permit ta be created against the property subject to this Deed of <br />Trust any liens inferior or superior to the iien of this Deed of Trust and further <br />that he wil( keep and maintain the same free from the claim of all persons <br />supplying labor or materials which will en#er into the construction of any and <br />ail buildings now being erected or fo be erected on said premises. <br />h. He will not rent ar assign any part af the rent af said property or <br />demolish, remove, or substantially alter any building without the written <br />consent of the Benef�ciary. <br />9. !n the event the Trustar fails to pay any Federal, Stafie, or Local Tax <br />Assessment, incame tax or other tax lien, charge, fee, or other expense charged to <br />the property hereinabove described, the Beneficiary is hereby authorized to pay the <br />same and any sum so paid by the Beneficiary shall be added to and become a part <br />of the principal amount of the indebtedness evidenced by said promissory note. [f <br />the Trustor shail pay and discharge the indebtedness evidencsd by said promissary <br />note, and shall pay such sums and shall discharge a(I taxes and liens end the casts, <br />fees, and expenses of making, enforcing and executing th4s Deed of Trust, then <br />upon written request of the Beneficiary and the surrender of the Deed of Trust and <br />the note ta the Trustee, the Trustee shall, after payment by Trustor af the Trustee's <br />fees, recanvey the property to the Trustor, or to the person or persons legal[y entitled <br />fihereto. <br />10, The Trustar covenants that he is iawfully seizeci and possessed af and <br />has the right to seil and convey said property; that the same is free from all <br />encumbrances except liens and encumbrances naw of record; and that he hereby <br />binds himself and hIs successors in interest to warrant and defend the title aforesaid <br />thereto and every gart #hereof against the lawful claims of aU persons whomsoever. <br />11. �or better security of the indebtedness hereby secured the Trustor, <br />
