20110300� <br />ACCESS EASEMENT AGREEMENT <br />This Access Easement Agreement is made and entered into this �� day of e <br />2011, by and between NE COLORADO CELLULAR, INC., d/b/a VIAERO � <br />WIRELESS, hereinafter referred to as Grantor, and C& V, L.L.C., a Nebraska limited <br />liability company, hereinafter referred to as Grantee. <br />WHEREAS: <br />a. Grantor is the owner of a certain tract of land legally described as <br />Lot One (1), C& V Administrative Subdivision, Village of Doniphan, Ha11 County, <br />Nebraska. <br />b. Grantee is the owner of a certain parcel of land located on a tract of <br />land comprising a part of the Lot Two (2), C& V Administrative Subdivision, Village of <br />Doniphan, Ha11 County, Nebraska. <br />c. Grantor has agreed with Grantee to grant Grantee a perpetual <br />nonexclusive easement in favor of and appurtenant to Grantee's parcel over and across the <br />Grantor's real property easement legally described as follows: <br />A tract of land being part of Lot 1, C& V Administrative Subdivision, <br />Village of Doniphan, Hall County, Nebraska, more particularly described as <br />follows: Beginning at the Southwest corner of said Lot 1; thence Easterly on <br />the South line of said Lot 1 a distance of 229.93 feet to the Southeast corner <br />of said I.ot 1; thence Northerly on the West line of said Lot 1 a distance of <br />74.30 feet; thence Westerly and perpendicular to the West line of said Lot 1 <br />a distance of 50.0 feet; thence South on the West line of said Lot 1 a distance <br />of 24.3 feet; thence Westerly on the North line of said Lot 1 a distance of <br />179.90 feet to the Easterly right-of-way of First Street as platted in said <br />Village; thence Southerly on said Easterly right-of-way a distance of 50.00 <br />feet to the point of beginning. Containing 0.29 acres, more or less. <br />for the purpose of vehicular ingress and egress to and from Grantee's parcel. <br />NOW, THEREFORE, for and in consideration of the prernises and other good and <br />valuable consideration, receipt and su�ciency are hereby acknowledged, the parties hereby <br />agree as follows: <br />1. RECITALS. T'he foregoing recitals are true and correct and are <br />incorporated herein by this reference. <br />2. GRANT. Grantor hereby grants to Grantee a perpetual nonexclusive <br />easement (access easement) in favor and appurtenant to Grantee's parcel over and across the <br />Grantor's real property said easement legally described as follows: <br />
