201100744 <br />comply with the provisions of this paragraph within thirty (30) days thereof, this Agreement shall <br />constitute an actual grant, assignment, and conveyance of the property and rights in such manner and <br />with such force and effect as shall be necessary to effectuate the terms of this Agreement. The titles <br />appearing in each numbered paragraph at the commencement thereof shall not be construed or <br />considered as part of the body of this Agreement but shall be considered as general identification <br />only of the contents of the respective paragraphs. <br />11. Waiver of Breach. No waiver of any breach by either party of the terms of this <br />Agreement shall be deemed a waiver of any subsequent breach. No modification of this Agreement <br />shall be binding upon either of the parties unless reduced to writing and subscribed to by both <br />parties, unless ordered by Court. <br />12. Approval of the District Court.
