Unless an agreement is macie in writing or Applicable L.aw <br />requires interest to be pa.id an such insurance proceEds, Lender shall not be required to pay Borrower any <br />interest or earnings on such proceeds. Fees for public adjusters, or nther third parties, retained by <br />Horrawer shall not be paid out of the insurance proceeds aud shall be the sole obligation of Barrnwer. If <br />the restoration or repair 'rs not econo�aically feasible or Lender's security would be lessen�i, the insurance <br />procee�s shall be applied to the sums secured by this Se�urity Ir�strument, whether or not ther� due, with <br />the excess, if any, paid to Borrower. Such insuranc� proc�eds shall be applied in the order provided for in <br />Section 2. <br />If Borrower abandons the Property, Lender may file, negotiate and settle any availaiale insurance <br />claim and related matters. If Borrower does not respond within 30 days to a notice from i,�nder th.at the <br />insurance carrier has offered to settle a claun, then Lender may negotiate and settle the claim. The 30-day <br />period will be�in when the notice is �iven. In either event, or if Lender acc�uires the Property under <br />Sec[ion 22 or otherwis�, �o�rtawer hereby assigns to Lender (a) Borrower's rights to any insurance <br />proceeds in an amount not to excced the amounts unpaid under the Note or Ct�uis SeerYrity Instrumenk, and <br />(b) any other of Borrower's rights (other than the right to any refund af uneame� prerniums paid by <br />Borrower) under all insurance policies cnvering the Property, inscyfar as such rights are applicable to the <br />coverage of the Property. Lender may use the insurance proceEds either to repair or restore the Property or <br />tp pay arnounts unpaid under the Note or this Security Insmiment, whether or not then due. <br />d. Occupancy. Horrower shall occupy, establish, and use the I'roperty as Sorrower's principal <br />residence withi.n 60 days after the ex�ution af Chis Security Instrument and shall continue to accupy the <br />Property as Borrower's principal residence for at least one year after the date of occupancy, unless L,�nder <br />otherwise agrees in writing, which consent shall not be unreasonably withheld, ar unless extenuating <br />circumstances exist which are beyond Borrower's control. <br />7. Preservation, Maintenance and Protection of the Properky; Inspec�ions. Borrower shall not <br />destray, darnage or impair the Property, allow the Property to dete�iorate or comrnit waste on tha <br />Property. Whether or nat Borrower is residing in the Property, Borravc+er shall maintain the Property in <br />arder to prevent the Praperty from deteriorating or decreasing in value due to its condition. Unless it is <br />determined pursuant to Section 5 that repair or restaration is not economical.ly feasible, Borrower shall <br />pcamptly repair ths Property if damaged to avoid furCher deterioration or damage. If i.nsurance or <br />condemnation prnceeds are paid in connection with damage to, or the taldng of, the Property, Borrower <br />shall be responsible for repairing or restoring the 1'roperty only if L.ender has relea.sed procee�s far such <br />purposes. Lender rnay disburse proc,eeds for the repairs and resCoration in a single payment or in a series of <br />progress payments as the work is completed. If the insurance or condemnation proceeds are not sufficient <br />to repair ar restore the Froperty, Bonrower is not relieved of Borro�ver's obligatinn for the eompletion of <br />such repair or restoration. <br />I.ender or its agent may malca reasonable entries upon and inspections of the Property. If it has <br />reasonable cause, Lender may inspect the interiar of ihe improvements on the Property. L.euder shall give <br />Borrower rzotice at the time of or prior to such an interior irrspe�tion specifying such reasonable cause. <br />8. Borrower's Loan Application. Sorrower shall bc in default if, during the Loan applicatian <br />process, Borrawer or any persons ox entities acting at the direction of Aortower or with Borrower's <br />knowledge or consenc gave �aterially false, misleading, or inaccurate infarrnatian or statements ta I.ender <br />(or failed to provide L.Ender with material inforn�ation) in connection with the Loan.
