<br />21. Hazardous Substances. Aa used in tb,is Section 21: (a) "Hazardous Substauces" are those
<br />substances defined as tnxic or hazardnus subst�nces, pollutants, ar vrastes by Environmental I_,aw and tl�e
<br />following substances: gasoline, kerasene, othez' �lananaable or toxic petroleum products, toxie pesticides
<br />and herbicides, volatile solvents, znaterials containing asbestos or farmaldehyde, and radioactive materials;
<br />(b) "Envzronmental Law" means federal Iaws and laws of the jurisdictivn where the Property is lnca.ted that
<br />relate to health, safety or environmentaI protection; (c) "Environmental Cleanup" includes any res�aonse
<br />action, remedial action, or re�qaoval actzou, as defined zn Envixazumemtal Law; and (d) an "Environme�atal
<br />Condition" means a candition that can cause, contribute to, or othexwise txigge�r an Environmental
<br />Cleanup.
<br />Borrower shall not cause or perttxit the presence, use, disposal, storage, or release of any Hazardous
<br />Substances, or threaten to release aiay Hazardous Substmr�ces, an or in the ProperLy. Borrower sha11 not da,
<br />nor allow anyane else to do, anything at�'ectin.g the �roperty (a) that is iz� viola�:ion of any Envaronnxental
<br />Law, {b) which creates an Environmental Conditivn, rnr (c) which, due to the pzesence, use, ox release of a
<br />Hazardous Suhstance, creates a condition t}�at adve�rsely affects tb.e valuo of The Property_ The preceding

<br />Ha�rdous Substance or Environmental Law of which Borrow�r has actual knowledg�, (b) any
<br />�nv'rxonmental Condition, iucluding but not li[nited ta, any spilling, leaking, dischazge, release pr threat of
<br />release of azry Hazardous Stiubstance, and (c) any enndition caused by the presence, use qr release of a
<br />Hazardous S�bstax�ce which adversely afFects the value of the Praperiy. If Borrower learns, or is no#ified
<br />by axzy governmental vr reguIatory authority, ar any priv�te party, that ar►y removal or other rcmediation
<br />of any Hazardous Substance affecting the Property is necessary, Borrower shall gromptly take all necessary
<br />reimed�ial actions in accordauce with �nvironrnental Law. Nothing herein shall create any obligafiian on
<br />Lender for a�t �nvironmentat Cleanup.
