RICE AND CHRISTINE L. RICE husb�nd and wife, Trustors, and <br />FIRST NATIONAL BANK OF OMAHA as Trustee and WEST GATE BANK as Beneficiary, <br />Said �3ee� of Trust �vt�s recardecl Ju!y 3, ?0��, _as Instrument No. 2006-05891 af the Mortgage <br />Records of Hall County, Nebraska. Said Deed of Trust was assigned by the original Beneficiary, <br />WEST GATE BANK, to FIRST NATIONAL BANK OF OMAHA, by virtue of an <br />Assignment dated June 23, 2006, and filed for record on July 3, 2006, as Instrument No. 2006- <br />p5892 af the Mortgage Records of Hall County, Nebraska. <br />FIRST NATIONAL BANK OF OMAHA, Grantor, in consideration of the sum of <br />Forty One Thousand Six Hundred and p0/lOQths dollars ($�41,600.00) and other good and <br />valuable consideration received from FIRST NATIONAL BANK OF OMAHA, does hereby <br />grant, bargain, sell, convey and confirm unto FEDERAL NATI4NAL MORTGAGE <br />ASSOCIATION (hereinafter "Grantee" where appropriate), the following-described real <br />prop�rty..in Hall County, Nebraska, to wit: <br />THE EAST ONE-HALF OF LOT ELEVEN (11) AND ALL OF LOT TWELVE (12), <br />BLOCK " D", FIRST ADDITION TO WOOD RIVER, HALL COLINTY, NEBRASKA. <br />to have and to hold the abave-described premises together with all tenements, hereditaments and <br />appurtenances thereunto belonging unto the Grantee at�d to Grantee's successors and assigns <br />farever. Grantor does hereby covenant with Grantee and Grantee's successors and assigns: <br />1. That DALE A. RICE AND CHRISTINE L. RICE, husband and wife, Trustors, failed <br />to �,ay ta Ben��iciary payments which were contractually due, and the Grantor, at the <br />request of the Beneficiary, elected ta decla.re the entire unpaid principal balance, tagether <br />with interest thereon at ance immediately due and payable. <br />2. That a Notice of Default as required by § 76-1006 was filed by Grantor on September 8, <br />201 �, as Instrument No. 2010-06418 of the Miscellaneous Records in the office of the <br />Register of Deeds of Hall County, Nebraska. A copy of said Notice of Default was <br />thereafter mailed to all parties entitled ta notice, pursuant to said Deed of Trust and in <br />compliance with § 76-1008, R.R.S. Nebraska. <br />3. That the Trustor failed to cure the default referenced in the Notice of Default within 30 <br />days after filing of the Natice af Default. <br />4. That a Notice of Trustee's Sale was filed by Grantor on October 19, 201 Q, as Instnunent <br />No. 2010-0768Q of Miscellaneous records of the Register of Deeds of Hall County, <br />Nebraska. A copy of said Notice of the time and place af the sale was thereafter mailed <br />to all parties entitled to natice pursuant to said Deed of Trust and in compliance with § <br />75-1008, R.R.S. Nebraska. <br />6. That Grantar as required by § 76-1�07 published Notii;e of Trustee's Sale to b�e helc�-en <br />November 29, 201 p, at 10:00 a.m. in the lower lobby of the Hall Caunty Courthouse, 111 <br />West First Street, Grand Island, Nebraska. Said Natice was published in the Grand <br />Island Inde endent, a legal newspaper of Grand Island, Hall County, Nebraska, once a <br />week for five consecutive weeks commencing on Octaber 19, 2010, and ending <br />November 16, 2010.
