Unless an agreement is made in vvriting or Applicable Law <br />requites illtet�st to be paid otl SuCh inci�ran� p I.ender shall not be required to pay Borrower any <br />interest or earnings an such proceeds. Fecs far public adjusters, or other third pazties, retained by <br />Horrower shall not be paid out of the insurance proceeds and shail be the solo obligation of Borrower. If <br />the restoratian or repair is nat e�onoxnically feasible or Lender's secucity would b� lessene�, the inswran,ce <br />proceeds shall be applied to the sutns se�ured by ttus Security Instrutnent, whethe�r or not then due, with <br />the axce.ss, if any, Paid to Borrower. Such insurance procecds shall be applicd in the order provide� for iun <br />Section 2. <br />If Bc�rrower abandans the Prnperty, Lender may file, c�egotiate and setCle any available insuranee <br />claim anci related rnatters. If Borrowe�r docs npt r�spond within 3p days to a notice from Lcnder that the <br />insurance carrier has offered to settle a claim, then I.�nder may negotiate and settle ttxe clairn. The 30-day <br />period will begin when the notica is given. In either event, or if I.ender acquires the Pmperty undsr <br />Section 22 or otherwise, Horrower hereby assigns to L,ender (a) Borrower's rights to any insurance <br />pmcee�s in an amaunt not to exceed the amounts unpaid under the Note ar this Se�urity lnstrument, and <br />(1�) anY ather of Barrower's rights (other than the right to any refund af uneame� pr�miums paid by <br />Borrower) under all ixisurancc policies covering th� Property, ixtsofar as such rights arc applicable tv the <br />coverage of t�e Property. Lender may use the insurance proceeds cither to repair or restore the Property or <br />to pay a�unts unpaid under the Nate or this Se�urity Instrument, whet�r or n�ot then due. .. <br />6. Oocupancy. Borrowcr shall occupy, establish, and use the Property as Hoirrower's principal <br />residence withiu 60 days after the executian of Chis Securiity Instrument and shall cantinue to nccupy the <br />Properiy as Borrower's principal reside�ace for at least onc year after the date of occttpancy, unless I.ender <br />otherwise agrees in writing, wtuch consent shall not be unreasonably withheld, or unless extenuating <br />circut�astances eatist which are beyond Borrnwer's control. <br />7. Preservatlon, Mainte�wamce and Pcot�eHon of the Properiy; L�pecbions. Barrower shall not <br />destroy, dar�age or impair the Property, allow tha Property to deteriorate or commit waste on the <br />Ptoperty. Whether or not Borrowe�r i�s residimg in thc Frop�rty, Horrower s1�all maintaint the Praperty in <br />order ta prevent the Property from deteriorating or decreasing in value due to its condition, Unless it is <br />deternuned pursuant ta Section 5 that repair or restoaration is not economicall,y feasible, &>rrower shall <br />promptly repair the Property if darnaged to avaid further deterioration ar damage. If insurance or <br />condemnation proceeds arc paid in connec.�tion with damage to, or the tal4ng of. the Property, Borrower <br />shall b� xesponsible far repairing or restaring th� Property pnly if Lender has relea�sed proceeds for such <br />Purposes. Lend� may disburso procceds for the repairs and r�toration in a single payment or in a series of <br />progress paymcnts as the work is complete�. If the insurance or candemnation proceeds are not suffiicient <br />W z+epair or �restore the Property, gonrower is not relieved of Borrower's obligation for the cornpletion of <br />such repair or �storation. <br />I.ender or its agent may make reasanable entries upon and inspections of the Property. If it has <br />reasonable cause, Le�er may inspect the interior of the improv�:nts cm the Praperty. I.ender shall give <br />Borrower notice at the tune of or prior to sueh an interior inspection specifying�sueh reasonable cause. <br />8. Borrower's I,oan Application. Bonrower ;shall be in default if, during the Loan, application <br />p�s, Harcower or any persons or entaities acting at the direrxivn of Borrower or with Borrower's <br />knnwladge or consent gave materially falsc, rnisleadi�ang, or inaccurate inforn�ation or statiemeents to �.ender <br />(or failed to provid� L,ender with material infonpnation) in� connection with the l.oan.
