2010U899� <br />be an additional debt secured by this Deed of Trust in like manner <br />with the principal debt herein described; (e) B�neficiary, or its <br />agents, representatives ar workmen, are authorized to enter at any <br />reasonable time upon or in any part of the Proper�y for the <br />purpose of inspecting th� same and for the purpose of performing <br />any of the acts it is authorized to perform under th� terms of <br />this Deed of Trust; (f) any forbearance by Beneficiary or Trustee <br />in exercising any riqht or remedy hereunder, or otherwise a�forded <br />by applicable law, shall not be a waiver of or preclude the <br />exercise of any such right or remedy hereunder; similarly, the <br />waiver by Beneficiary or Trustee af any de�ault of Trus�or under <br />this Deed of Trus� shall not be deem�d a waiver of any other or <br />similar defaults subsequ�ntly accurring; (g) extensian of the <br />time for payment or modification or amor�ization of the sums <br />secured by this Deed of �rust g�anted by Beneficiary to any <br />successor in interest of Trus�or shall not operat� to release, in <br />any manner the liab�lity of the original Trustor and Trus�or's <br />successar in interest. Beneficiary sha11 not be required �o <br />commence proceedings aga�nst such successar or refuse �o extend <br />the time for payment or otherwise modify amortization of �he sums <br />and indebtedness secured by this Deed of Trust by reason of any <br />d�mand made by the original Trustor and Trustor's successors in <br />int�rest; (h) withou� a�fecting the liability of the Trustor or <br />any other person liable for the payment of the abl�gations and <br />ind�btedness secured by this Deed af Trust, and without affecting <br />the lien or charge at this Deed of Trust upon any portion of the <br />Property not then or theretofore released as security for the full <br />amount of all unpaid obligations, Beneficiary may, from time to <br />time and withou� nota�ce (i) releas� any persan so liable, (ii) <br />extend the a:naturity or alter any af the terms of any such <br />obligation, (iii) grant other indulgences, (iv) release or <br />reconvey, or cause to be released or reconveyed at any time at <br />Benefi.ciary's option any parcel, portion af or al1 of the <br />Property, (v) take ar release any other or addi�ional security for <br />any abligation or indebtedness herein mentioned, or (vi) make <br />compositions or ather arrangements with debtors in relation <br />�hereto; (i) in addi.tion to the rights and powers given to the <br />Trustee and Beneficiary herein, the Beneficiary shall have a11 <br />such other rights both in law and equity for coll�ction of the <br />indebt�dness secured hereby as it would have but for this Deed of <br />Trust; (j) all covenants and agreements of Trustor set forth in <br />�his De�d of Trus� shall be join� and several; (k) this Deed o� <br />Trust sha11. be governed by the laws of the State of Nebraska; <br />(1) in the event any one or more of th� provisions contained in <br />this Deed of Trust, or the Note ox any athe� security ins�rument <br />given in connection with the indebtedness hereby secured shall for <br />any reason be held to be invalid, illegal or unenforceable in any <br />respect, such invalidity, fllegality, or unen�orceability shall, <br />at the option o� Beneficiary, not affect any other provision of <br />�his Deed of Trust, but this Deed of Trus� sha11 be construed as <br />if such invalid, illegal, or unenforceable provision had never <br />b�en contained herein or therein. If the lien of this Deed of <br />Trust is inva�id or unenforceable as to any par� of �he <br />indebtedness hereby secured or evidenced by the Note, or if the <br />lien is invalid or unenforceable as ta any part of the Proper�y, <br />the unsecured or partially secured portion of such indebtedness <br />shall be completely paid prior to the payment of the remaining and <br />s�cured or partially secured portion of such a.ndebt�dness, and all <br />payments made on such indebtedness, whe�her voluntary or under <br />foreclosure or other enfarcement action or procedure, shall be <br />considered to have been first paid on and applied to the full <br />payment of �hat partion of such indebtedness which is not secured <br />or not fully s�cured by the lien of this Deed of Trust; and (m) <br />the covenants and agreements contained in this Deed of Trust sha11 <br />bind, and the benefits and advantages hereof shall inure to the <br />respective heirs, executors, administratars, successors and <br />assigns of the parties heret�.
