2010U8999 <br />be conducted at the real estate farm�ng a <br />at the court hous� in the county in which <br />or some part thereof, is situated. <br />part of the Proper�y or <br />the Property to be sold, <br />(b) When Trustee sells pursuant t� the pow�rs herein, Trustee <br />shall apply the proc�eds of the sale to payment of the cas�s and <br />expenses of exercising the power of sa1.e and of the sale, <br />including, without lzmitation, the payment of Trustee's fees <br />incurred, which Trust�e's fees shall not in the aggrega�e exceed <br />the sum of One Do11ar ($1.00) plus l� of the amount secured hereby <br />and remaining unpaid and then ta the items set forth in <br />subparagraph (c) of �his paragraph FTFTH in the order therein <br />stated. <br />(c) Af�er paying the items specified in subparagraph (b) of this <br />paragraph FIFTH, if �he sale is by Trustee, or the proper cour� <br />and oth�r costs of foreclosure and sale if sale is pursuan� to <br />judicial forecl�sure, the praceeds of sale shall be applied in the <br />order sta�ed below to the payment o�: <br />(1) Cc�st of any evidence of title procured in <br />connection with such sale and of any rev�nue r�quired <br />ta be paid; <br />(2) All sums then secured hereby; <br />(3) The remainder, if any, to the person or persons 1eqa11y <br />entitled there�a. <br />Each af the parties to this Deed of T.�ust hereby requests that a <br />copy af any Notice af Default and a copy of any Notice of Sale <br />provided for hereinabove be mailed to each such party at his post <br />office address set forth herein. Upon the occurrence of any <br />default hereunder, Beneficiary shall have the option to foreclose <br />this Deed af Trust in the manner provid�d by law far the <br />foreclosure of mortgaqes on real praperty. <br />SIXTH: Trustor specifically agrees that (a) Trustor, at <br />its expense, will execute and deliver to Beneficiary, promptly <br />upon r�quest, such security instruments as may be required by <br />Beneficiary, in a form and substance satisfactory to Beneficiary, <br />cov�ring any of the Property conveyed by this Deed of Trust which <br />security instruments shall be additional security for Trustor's <br />faithfu�. performance of a11. of the t�rms, covenants and conditions <br />af this Deed of Trust, the Note and indebtedness secured hereby, <br />and any other security instrurnents executed in connection with the <br />indebtedness secured by this Deed of Trust; and al1 such <br />instruments shall be £il�d and recorded at Trustor's expense; (b) <br />Beneficiary may, fram time to time, by written .instrument <br />executed and acknowledged by Beneficiary, mailed to Trustar and <br />recorded in the county or counties in which the Property is <br />located and by atherwise complying with the provisions of the <br />applicable l.aws of the State of Nebraska, substitute a successar <br />or successors to the Trustee named herein or acting hereunder; <br />(c) although the Trustee, or his successor or successors, may be <br />an agent af, or a�torney for, or otherwise connected with the <br />Ben�ficiary, such fac� sha11 not be construed to disqualify him t� <br />act as such Trust�e, nar shall such fact p�event the Trustee or <br />Beneficiary from bidding at a sale and buying any part or a11 of <br />the Property at any sale hereund�r; (d) that if it should be <br />necessary ar appropria�e for the protection of the securi�y hereby <br />conveyed or enfarcement of the deb� hereby secured, tor the <br />trustee or the Beneficiary to insti�ute or become a party to any <br />proceeding ar suit in a court of bankruptcy or probate or other <br />court of general or limited jurisdiction, all expenses ;and costs <br />properly incurred by said Trustee or said Beneficiary (i.ncluding <br />reasonable attarneys' fees) paid or incurred by said Trustee or <br />Beneficiary in maintaining, prosecuting or defending such <br />proceeding or protecting th�ir respective rights hereunder sha11. <br />[:� <br />
