201008701 <br />Unless otherwise agreed in writing, all insurance proceeds shall be applied lo the restoration or repair of the Properly or io <br />the Secured llebt, whether or not then due, at Beneficiary's option. Any application of proceeds to principal shall not <br />cxtend or postpoue the due date of the scheduled payment n�r change the amount of any payment. Any excess will be paid <br />to the Grantor. If the Property is acquired by Beneficiary, Trustor's right to any insurance palicres and proceeds resulting <br />from d�►mage to the Property before the acquisition shall pass to BenEficiary to the extent of the Secured Debt imrnediately <br />befare the acquisition. <br />20. ESCROW FOR TAXES AND INSURANCE. LJnless otherwise provided in a separaie agreerr�ent, Trustor will not be <br />required to pay to I3eneficiary funds for taxes aud insarance in escXOw. <br />21. FINANCIAL REPORTS AND ADDITIONAL DOCUMENTS. Trutitor will provide to Beneficiary upon request, any <br />financial statemenl or iuformation Beueficiary may deem reasonably necessary. Trustor agrees to sign, deliver, and file auy <br />additional documents or cerlifications that Beneficiary may consider necessary to perfect, continue, and preserve Grantor's <br />obligations under this Securiry Instrurnent and Beneficiary's lien status on the Property. <br />22. JO]NT AND INDNIDUAL LIABILITY; CO-SIGNERS; SUCCESSORS AND ASBIGNS BOUND. All duties under <br />this Security Instruanent are joint and individual. If Trustor signs this Security Instrurnent but does not sign an evidence of <br />debt, Trustor does so only lo mortgage Trustor's interest in the Propert.y lo secure paynczept of the Secured Debt and <br />Trustor does not agree to be personally liable on the Secured Debt. If this Securily Instrumeut secures a guaranty between <br />Beneficiary and Trustar,.-Tn�ator egrees to waive any rights that may prevent Peneficiary frorn bringing any action or claim <br />against Trustor or any party indebted nnder the obligation. These rights may include, but are uot limited to, any <br />ant.i-deficiency or one-actian laws. Trustor agrees that Beneficiary and any parly tc> this Security Instrument may extend, <br />modify or make any change in the tetxtis of this Security Instrument ar any evidence of debt without Trustor's consent. <br />Such a chan�e will nnt release Trustor from the terms of this Security Instrurnent. The duties and benefits of this Security <br />Instrument st�ll bind and benefit the successors and assigns of Trustor and Beneficiary. <br />23. APPLICABLE LAW; SEVERABILITY; INTERPRETATION. This Security Instrument is governed by the laws of the <br />jurisdiction in which Beneficiary is located, except to the extent otherwise required by the laws of the jurisdiction where <br />Che Property is located. This Security Instrument is complete and fully iutegratcd. This Securily Instru.menl may noi be <br />ainended or modified by oral agreernent. Any section in this Security lnslrument, attachrnents, or any agreement related to <br />the Secured Debl that contlicts with applicablc law will not be effeclive, unless that law expressly or unpliedly penuits the <br />variations by written agreemeni. If any section of this Security InstruznenC cannot be enforced accordipg to its terms, that <br />section will be severed and will not affect the enforceability of the remainder of this Security instruttient. Whenever used, <br />the singular shall include the pinral and the plural the singular. The captions and headings of the sections of this Security <br />Instrument. are for convenience only and are not to be used to interpret or define the terms of this SecuKity Instrument. <br />Tune is of the essence in Chis Security Instrurnent. <br />24. SUCCESSOR TRUSTEE. Beneficiary, at Beneficiary's option, may from time to time remove Trustee and appoint a <br />successor trustee without any other formality than the desigrution in writing. The successor trustee, without conveyance of <br />the Property, shall succeed to all the title, power and duties conferred npon Trustee by this Security Instrumenl and <br />applicable law. <br />25. NOTICE. Unless otherwise required hy law, any notice shall be giveu by delivering it or by mailing it by first class mail <br />to the appropriate party's address on page 1 of this Security Instrument, or lo any other address designated in writing. <br />Notice to one trustor will be deemed to be notice to all trustors. <br />26, Wt�,][VE��. Except to the extevt prohibited by law, Trustor waiv�s all appraiseinenl and hamestead exemption rights <br />relating to the Property. <br />27. OTHER TERMS.
