2oioo��si <br />Section 6. Date of Commencement of Monthly Assessments: Due Dated. The regular annual <br />assessments provided herein as to all Improved Lats sha.11 cammea�ce the �'ixst day af the month fallpwing <br />the month during which the coa�structaon of a dwe�.iug on said Lot shall be completed and a Certificate af <br />Occupancy, if required, is issued by the appropriate governmental authority. Priox to such date, each Lot <br />shall be deemed an Unimproved Lat. All Lots owned by the Declarant shall be Unimprovcd Lots until the <br />first day of the month following the date residence is constructed thereon or the Lot sold to a tb�,ixd party. <br />The Board af Directors shall fix the a�nouut of the �onthly assessment against each Lot at its annual meeting <br />£ollowing tl�e anwual meeting of the Members of the Assaciatinn. Written notice of the az�n.ual assessment <br />shall be sent to every Owner subject thereto. The Assaciation shall, upon demand, and for a reasonable <br />charge, furxi.ish a certi.ficatian signed by an officer of the Association setting forth whether the assessments <br />on a speci�ied Lot have been paid. <br />Section'7. EffecCive Non-Paynrxent af Assessments - Rernedie$ pf the Associati_c�n. Any assessment <br />installment wh.ich is not paid when due shall be delinquent. Tf the assessment installment is not paid vvithin <br />thirty (30) days after the due date, the asseasment shall bear interest from the due date at the rate of l Z% per <br />annum. The Association may bring an action at law against the Owner persanally obligated to pay tb.e sazne, <br />or foreclose the lien against the property in accordance witl�. law. Zn either a persanal or foreclosure action, <br />the Asso�iation shall be entitled to recover, as pact of the actian, the interest, cost and reasonable attorney's <br />fees with respecC to the action. No Owners may .waive ar otherwise escape liability for the assessments <br />pxovided �ax �erein by non-use of, lease, ox abandozunent of his or her Lot. The mortgagee of the subject <br />property shall have the right to cure any delinquency of any Owner by payment of all sums due, together <br />with interest, costs and fees. Thc Assaciation shall assign to such m.ortgagee all of its rights with respect to <br />such lien and right of £oreclosure ta the mortgagee. <br />Section 8. Subordi.nat'on of the Lien to the Mart�a��s. The lien of the assessments provid�d for <br />herein shall be subordinate to the lien of any first xnortgage. <br />Section . Exem t Pra ert . None of theProperties subj ect to this Declaration shall be exempt frorn <br />the assess:tx�ents created herein. <br />I:]::71Y�y�4l'I <br />ARCHITECTUR.AL CONTROL <br />An Architectural Control Co�nmittee shall be formed by the Owners of Lots One (1) throug]a Eight <br />(8), Centura Hills East Fourth 5ubdivision, Lots Twa (2) through Saventeen (1'�, B1ockTwo (2) of Centuxa <br />Hills East Subdivision, Lots Two (2) through Eight ($), Block One (1.), Centura Hills East Subdivisiaz�, and <br />Lat Twv (2), Centura Hills East Second Subdivision, and shall consist of five (5) members. �our (4) of these <br />member sha11 be elected by a majarity vote of the Owners of these Lots. The remaining member shall be <br />a representative of Centura Hi.l.ls Golf Club, LLC as appoin.ted by its Board of Directors. Eacli Lot sha11 be <br />given one vote regardless of the number of Owners of the Lot. Each Conr�ttee Membcr shall serve for a <br />�'ive-year term.
