<br />th� survey and original canstruction of the Grantee's electric transmission line. The
<br />Grantee agrees ta take all reasonable steps to restore, as nearly as passible to the
<br />candition it was in prior to canstruction, any land which is damaged as a result of said
<br />construction. Final payment shall be made an or before 60 days after completion of the
<br />original canstruction.
<br />The Grantee agrees ta pay the Grantor or Lessee, as their interests may appear,
<br />far any damage to persanal property, fences, livestack, and grawing crops and ta take
<br />all reasonable steps ta restore any land which is damaged after the original construction
<br />of the Grantee's electric transmission line resulting from the survey, operatian,
<br />maintenance, inspectian, repair, removal, alteration, relocation and reconstructian of the
<br />Grantee's electric transmission line. It is further agreed that all claims for such damages
<br />must be submitted to the Grantee in writing within 90 days of such occurrence;
<br />otherwise, it is agreed that said claim far damages shall have been waived.
<br />Grantee shall have the right to excavate and refill ditches and trenches
<br />necessary for such overhead and underground electric utilities and appurtenances; to
<br />remove, clear, and keep clear, all trees which would come within eighteen (18.0) feet of
<br />the nearest electric conductor; ta remove, clear, and keep clear, bushes, hedges,
<br />undergrowth, and/or any other abstructians interfering with the surveying, canstruction,
<br />inspection, maintenance, repair, replacement, relocation, extension, removal, and
<br />operation of such overhead and underground electric utilities and appurtenances. All
<br />refuse from cutting and trimming trees and bushes shall be removed and disposed by
<br />the Grante�.
<br />Grantee shall have th� right at any time, to relocat�, add, or upgrade such
<br />overhead and underground electric utilities and appurtenances connected therewith, in,
<br />upon, above, along, over, across, underneath, or through the eas�ment and
<br />right-af-way herein granted.
<br />Grantor shall not allow any structures, buildings, combustible materials or other
<br />property of any kind whatsoever, to be erected, constructed, placed, stored or
<br />accumulated in, upon, above, alang, over, acrass, underneath, or through the easement
<br />and right-af-way herein granted.
<br />Grantar may cultivate and use the land within the easement and right-af-way
<br />provided that such use shall not, in the judgment af the Grantee, endanger or be a
<br />hazard to, or interfere with the surveying, construction, inspectian, maintenance, r�pair,
<br />replacement, relocation, extension, removal, and operation of such overhead and
<br />underground electric utilities and appurtenances, and GranteE's full use of the
<br />easement and right-of-way.
<br />It is further agreed that Grantor has lawful possession of said real estate, good
<br />right and lawful authority to make such conveyance; and that Grantor an behalf of itself,
<br />all heirs, executors, administrators, successors, and assigns, hereby cavenants that the
<br />rights and priuileges herein granted shall run with the title to such tract of land, and be
<br />binding upon Grantor, all heirs, executors, administrators, successars, and assigns.
