<br />or lent, for services rendered, far r�ney lent, or advances or deposits made; all claims, actions,
<br />and causes of action (including thase arising in tort, xncluding cammercial tart claims) of Grantor
<br />against nthers; all ag�reements, contracts, certificates, instruments (including promissory nates,
<br />guaranties, liens and au writings which evidence a right to the payment of money), franchises,
<br />permits, licenses, plans, specificatians and other documents, now or hereafte,r entered into, and
<br />all rights therein and th�reto, respecting or pertaining to the use, occupation, construction,
<br />manag�n�nt or aperation of the Praperty or any pazt ther�enf or respecting any business or
<br />activity conducted an the P�roperty or any part thereof �nd all ri�ht, title and interest of Cnaritor
<br />therein and t�ereunder, including th� right to receive and collect any sums payable to Gramtvr
<br />t�iereunder; all extensions, Improvements, betterments, replacements, renewals, or additions and
<br />accessians to any of the foregoing; and any vth�r iatangibl� property of Grantoz� related to the
<br />Property; and
<br />TOGETF�R with and in addition to any other property ment�ioned above, all property in
<br />which a security interest may be creat�d puxsuant to the Uni�orm Camme�rcial Code (or any
<br />si�znilar laws) including all gaods, inventory, equipment, accounts, accounts receivable, contract
<br />rights, general intangibXes, chattel paper, documents, documents of title, instruments, deposit
<br />accounts, letter-of-credit rights, investment properiy, tart claims (including commercial tort
<br />claims), and securities located on or gene�rated by or used in conncctian with the ownership or
<br />operation of the Property; and
<br />TOGETHER with all pmceeds of the convarsion, voluntary or involuntary, af any of the
<br />foregoing including proceeds af ix�surance and Condemnation Awards, into cash or liquidation

<br />FURTHER WITNESSETH, that this Recapture Deed of Trust is bath a real property
<br />mortga�e and a"security agreement" within the meaning of the Nebraska Uni�onn Commercial
<br />Code (collectively the "Security Tnstrument"). The Properiy includes both real and personal
<br />properiy and all at}aer rights and interests, whether tangibl� or intangible in na.ture, of Cna�tar in
<br />the Property. By executing and delivering this Security Instrument, G�rantor hereby grants to the
<br />Authority, as security for the Qbligati�ans, a security interest in any of the Property that is deemed
<br />to be personal properiy to the full extent that such property may be subject to the Unifarm
<br />Commercial Code. This Security Instrument shall be and is intended tn serve as a financing
<br />statement under the Uniform Commercial Code with respect to the Persan�.l Property, and when
<br />filed shall ser�re as a fananeixig statement for all i�mtents and purposes thereunder. Grantar
<br />authorizes the Authority to file financing statezx�en.ts describing the Persanal Property. The
<br />Authority shall be entitled to all rights and remedies of a"secured party" under the Uniform
<br />Commercial Code. Upon its recarding in the real property records, this Security Instrument shall
<br />be effective as a fuiaxa,cing statement filed as a fixture filing and when fil�d shall serve as a
