�01007�3� <br />Section 10.4. Enforcement af Provisions <br />The Owner acknowledges that one af the primaxy purposes for requiring aampliance with <br />the provisions of this Agreement is to assure compliance with Section �Z of the Cade and the <br />Program Requirements. In consideration for receiving the Subaward, the Qwner hereby agrees <br />and consents that the Authority, the State and/ar the United States of America shall be entitled to <br />enforce specific perforrnance by the Owner (and its successors and assigns) of its obligations <br />under this Agreernent in any tribunal in the State far any and all breach of the conditians and <br />restrictions hereaf or rnaterial representations made by the Owner at any time in additian to all <br />other remedies expressly provided in this Agreement and/ar by law or in equity. <br />ARTTCLE XI <br />GENERAL PROVISIONS <br />Section 11.1. Notices <br />Except as otherwise specifically provided herein, all notices, dernands ar ather <br />cammunicatians hereunder shall be in writing and shall be deemed to have been given (a) two <br />(2) Business Days after being deposited in the United States mail and sent by certified or <br />registered rnail, postage prepaid, (b) one (1) Business Day after being d�livered to a nationally <br />recognized avernight delivery service, (c) on the day sent by telecopier or other facsirnile <br />transrnissian, answerback requested, or (d) on the day deliverecl personally, in each case, to the <br />parties at the addresses set forth below or at such other addresses as such parties may designate <br />by notice ta the Ownear: <br />(i) If to the Authority, 123p O Street, Suite 200, Lincaln, Nebraska <br />C8508-1402 Attn: Executive Director. <br />(ii) It'to the Qwner, at 2604 26th Ave., Central City, NE 6$$26. <br />(iii) If to the Tax Credit Investor pursuant to Section 6.3 or 10,3, at 13520 <br />California Street, Suite 250, Ornaha, NE 68154. <br />(iv) If to the Lender pursuant to Section 6.3 or 10.3 at P.O. Box 447, ] 0841 <br />North 142nd Street, Waverly NE 68462, <br />Section 11.2. Rules of Construction <br />Unless the context clearly indicates ta the contrary, the following rules apply to the <br />construction of this Agreement: <br />(a) V1/ords importing the singular nurnber include the plural number and <br />wards importing the plural number include the singular number; <br />(b) Words af the masculine gender include correlative words af the fernin'rne <br />and neuter genders, and vice-versa; <br />-20- <br />A841-2135-3478.2 <br />
