�flioo7s�5 (b) Requisitians can be submitted monthly ta the Autharity by no later than the tet�th (1Q` day of each manth. Each Requisition rnust be subrnitted for approval to the Authority, together with the cornplet�d and executed docurnents listed in Exhibit D, each in form and substance reasonably satisfactory to the Autharity (the "Draw Docurnents"). (c) The Authority shall submit a request for the Section 1602 Pragram Funds to the Treasury in an amaunt equal to the approved amount ofthe current Reauisition (not to exceed, in the aggregate, the amount of the Subawaxd) within five (5) Business Days of approval by the Authority af the Draw Documents. (d) The Owner sha11 cooperate with the Autharity in obtaining and providing axxy additional documentation that rnay be required by the Treasury to approve the request for the Section 1 fiQ2 Pro�ram Funds. (e) The Authoxity will withhold ten percent (10%) of the Subaward as retainage. Such retainage shall be released with the final disbuu af the Subaward; provided Che Qwner has satisfacta�ily performed the deseribed worlc in accardance with this Agreernent, the Recapture Deed of Trust and the Program Requirements have been met. (� The Ownear acknowledges and agrees that no Subaward shall be disbuxsed after the Expiratian Date; provided, however, that the Expiration Date may be extended at the sole discretion of the Autharity. To request an extension of the Expiration Date, the �wner must submit to the Autharity for their review and approval documentation (in form and substance acceptable to the Authority) reflecting that at least thirty percent (30%) ofthe total adjusted basis in Land and deprcciable property that is reasonably expected to be a part of the Froject has been. paid or incurred by �he Owner by Decennber 31, 2010. All Requisitions must be submitted to the Authority at least ten (10) Business Days prior to the Expiration Date. (g) The Authority will not make any disbursements to the Qwner for costs that: (i) are prohibited under the Program Requirenients; (ii) are not strictly in accordance with the terms of this Agreernent; (iii) are requested after the Expiration Date, unless such date is extend�d under Section 4.1(� herenf; (iv) wexe requested and/or incurred after terrnination of this Agreement; or (v) were requested during the occurrence and continuation of an uncured Event of Default. (h) The Authority is autharized ta make modifications to the disbursement pracedures set forth herein and to establish additianal requirements for disbursement of thc Subaward to the Owner as may be necessary or advisable for compliance with all the Progxam Requirements. .. 9 _ 4841-2135-3478.2
