<br />201006634 <br />have the right to utilize nearby ditch crossing from Abbott Road to access Grantee's <br />easement and right-of-way. <br />Grantor consents to the approval of the proposed construction of electrical <br />transmission lines and appurtenances by the Nebraska Power Review Board and <br />Nebraska Public Service Commission, without hearing, and waives any and all notice of <br />this matter before those two regulatory bodies. <br />Grantee will work with Grantor to place a power pole at a point approximately <br />one hundred eighty (1$0) feet ± south of the northern right of way line, approximately <br />thirty three (33) feet south of the north section line, and another pole will be placed at <br />approximately two hundred seventy (270) feet ± south of the first pole and another pole <br />will be placed within the pasture/ grass area north of the creek which crosses through <br />the Grantor's property, poles placed south of said creek will be placed at intervals <br />determined by Grantee's engineer, all poles will be placed within Grantee's easement <br />described herein. <br />The Grantee agrees to pay the Grantor or Lessee, as their interests may appear, <br />for any damage to personal property, fences, livestock, and growing craps caused by <br />the survey and original construction of the Grantee's electric transmission line. The <br />Grantee agrees to take all reasonable steps to restore, as nearly as possible to the <br />condition it was in prior to construction, any land which is damaged as a result of said <br />construction. Final payment shall be made on or before 60 days after completion of the <br />original construction. <br />The Grantee agrees to pay grantor herein Fift Five Thousand Two Hundred <br />Forty Four and 27/100 Dollars ($55,244^27) for the relocation of an irrigation well <br />outside the limits of Grantees easement and right-of-way described within said <br />easement, electrical and pipe work associated with the relocation of said irrigation well, <br />the purchase and installation of a culvert pipe on the south side of Abbott Road in or <br />near Grantees easement and right-of-way, and the purchase and installation of a corner <br />irrigation system. Compensation for said items above is included with easement <br />consideration described on page one of this document. Grantor shall abandon all <br />structures except new culvert that may fall within said easement and right-of-way on or <br />before March 1, 2011. <br />The Grantee agrees to pay the Grantor or Lessee, as their interests may appear, <br />for any damage to personal property, fences, livestock, and growing crops and to take <br />all reasonable steps to restore any land which is damaged after the original construction <br />of the Grantee's electric transmission line resulting from the survey, operation, <br />maintenance, inspection, repair, removal, alteration, relocation and reconstruction of the <br />Grantee's electric transmission line. It is further agreed that all claims far such damages <br />must be submitted to the Grantee in writing within 90 days of such occurrence; <br />otherwise, it is agreed that said claim for damages shall have been waived. <br />Grantee shall have the right to excavate and refill ditches and trenches <br />necessary for such overhead and underground electric utilities and appurtenances; to <br />remove, clear, and keep clear, all trees which would come within eighteen (1$.0) feet of <br />_2_ <br />
