201006634 have the right to utilize nearby ditch crossing from Abbott Road to access Grantee's easement and right-of-way. Grantor consents to the approval of the proposed construction of electrical transmission lines and appurtenances by the Nebraska Power Review Board and Nebraska Public Service Commission, without hearing, and waives any and all notice of this matter before those two regulatory bodies. Grantee will work with Grantor to place a power pole at a point approximately one hundred eighty (1$0) feet ± south of the northern right of way line, approximately thirty three (33) feet south of the north section line, and another pole will be placed at approximately two hundred seventy (270) feet ± south of the first pole and another pole will be placed within the pasture/ grass area north of the creek which crosses through the Grantor's property, poles placed south of said creek will be placed at intervals determined by Grantee's engineer, all poles will be placed within Grantee's easement described herein. The Grantee agrees to pay the Grantor or Lessee, as their interests may appear, for any damage to personal property, fences, livestock, and growing craps caused by the survey and original construction of the Grantee's electric transmission line. The Grantee agrees to take all reasonable steps to restore, as nearly as possible to the condition it was in prior to construction, any land which is damaged as a result of said construction. Final payment shall be made on or before 60 days after completion of the original construction. The Grantee agrees to pay grantor herein Fift Five Thousand Two Hundred Forty Four and 27/100 Dollars ($55,244^27) for the relocation of an irrigation well outside the limits of Grantees easement and right-of-way described within said easement, electrical and pipe work associated with the relocation of said irrigation well, the purchase and installation of a culvert pipe on the south side of Abbott Road in or near Grantees easement and right-of-way, and the purchase and installation of a corner irrigation system. Compensation for said items above is included with easement consideration described on page one of this document. Grantor shall abandon all structures except new culvert that may fall within said easement and right-of-way on or before March 1, 2011. The Grantee agrees to pay the Grantor or Lessee, as their interests may appear, for any damage to personal property, fences, livestock, and growing crops and to take all reasonable steps to restore any land which is damaged after the original construction of the Grantee's electric transmission line resulting from the survey, operation, maintenance, inspection, repair, removal, alteration, relocation and reconstruction of the Grantee's electric transmission line. It is further agreed that all claims far such damages must be submitted to the Grantee in writing within 90 days of such occurrence; otherwise, it is agreed that said claim for damages shall have been waived. Grantee shall have the right to excavate and refill ditches and trenches necessary for such overhead and underground electric utilities and appurtenances; to remove, clear, and keep clear, all trees which would come within eighteen (1$.0) feet of _2_
