P_ armley, Trustee of the Ellen E. Parmley Revocable._Trustdated <br />June~6, '1995, is the owner and developer of the two lots in Parmley Subdivision.; and <br />WHEREAS, there has been constructed on adjoining parts of Lot One (1) and Lot Two <br />(2), Parmley Subdivision, driveway improvements and a common garage, which driveway and <br />garage are located on the Lot line common to both Lots; and <br />WHEREAS, it is the desire of the owner to establish a driveway and garage easement <br />so that the common driveway can be used by the respective owners of each Lot and that the <br />common garage can also be used by the respective owners of each Lot; <br />NOW THEREFORE, in consideration thereof and of the mutual benefits to be derived by <br />the owners of Lots on said Subdivision and any purchaser or purchasers of Lots therein, their <br />heirs, successors, personal representatives and assigns, the owner hereby stipulates that the <br />two Lots in said Subdivision upon being sold, given, devised, transferred and conveyed, shall be <br />and the same are subject to the following restrictive covenants, all of which shall run with the <br />land as follows: <br />1. MUTUAL EASEMENTS. The owner of each Lot hereby grants to the owner of the <br />other Lot an easement of ingress and egress over so much of his respective property as is <br />presently improved as part of a driveway for vehicular traffic used in connection with their <br />respective properties and far access to the common garage.' The owner of each Lot shall park, <br />to the extent possible, on his driveway and will not park on the other's portion of the driveway. <br />2. OBSTRUCTIONS. The owner of each Lot shall not obstruct, impede or interfere with <br />the other's reasonable use of such driveway improvements far the purpose of ingress and <br />egress to and from their respective properties and to the common garage. <br />3. MAINTENANCE. The owner of each Lot shall maintain the respective driveway <br />improvements in a usable, neat and uniform manner so that the overall, appearance of the said <br />driveway improvements is that of one driveway. The owner of each Lot shall stand the expense <br />of upkeep and/or replacement of their respective driveway. If either party should create damage <br />to the others driveway, the one causing the damage shall stand the expense of repairs. <br />4. GARAGE. The owner of each Lot shall maintain his respective one-half of the <br />common garage in goad condition and repair at all times. Each party shall confer with the other <br />regarding painting, roofing, and other repair so as to make their respective portion of the <br />
