201002461 <br />rods north of the south line of said Northeast Quarter, thence southerly along the <br />west line of said Northeast Quarter a distance of Fourteen and one-half (14'/2) <br />rods to the south line of said Northeast Quarter, thence easterly along the south <br />line of said Northeast Quarter One Hundred Sixty (160) rods more or less to the <br />point of beginning. <br />The above-described easement and right-of-way containing a total of 0.89 <br />acres, more or less, as shown on the plat dated November 9, 2009, <br />marked Exhibit "A", attached hereto and incorporated herein by reference, <br />together with the following rights: <br />Grantee shall have unrestricted ingress and egress to the above-described <br />easement and rightTof-way for any purpose necessary far the surveying, construction, <br />inspection, maintenance, repair, replacement, relocation, extension, removal, and <br />operation of such overhead and underground electric utilities and appurtenances. Such <br />rights of ingress and egress shall be exercised in a reasonable manner. <br />Grantor consents to the approval of the proposed construction of electrical <br />transmission lines and appurtenances by the Nebraska Power Review Board and <br />Nebraska Public Service Commission, without hearing, and waives any and all notice of <br />this matter before those twa regulatory bodies. <br />The Grantee agrees to pay the Grantor or Lessee, as their interests may appear, <br />for any damage to personal property, fences, livestock, and growing crops caused by <br />the survey and original construction of the Grantee's electric transmission line. The <br />Grantee agrees to take all reasonable steps to restore, as nearly as possible to the <br />condition it was in prior to construction, any land which is damaged as a result of said <br />construction. Final payment shall be made on or before 60 days after completion of the <br />original construction. <br />The Grantee agrees to pay the Grantor or Lessee, as their interests may appear, <br />for any damage to personal property, fences, livestock, and growing crops and to take <br />all reasonable steps to restore any land which is damaged after the original construction <br />of the Grantee's electric transmission line resulting from the survey, operation, <br />maintenance, inspection, repair, removal, alteration, relocation and reconstruction of <br />the Grantee's electric transmission line. It is further agreed that all claims for such <br />damages must be submitted to the Grantee in writing within 90 days of such <br />occurrence; otherwise, it is agreed that said claim for damages shall have been waived. <br />Grantee shall have the right to excavate and refill ditches and trenches <br />-2- <br />
