201002461 rods north of the south line of said Northeast Quarter, thence southerly along the west line of said Northeast Quarter a distance of Fourteen and one-half (14'/2) rods to the south line of said Northeast Quarter, thence easterly along the south line of said Northeast Quarter One Hundred Sixty (160) rods more or less to the point of beginning. The above-described easement and right-of-way containing a total of 0.89 acres, more or less, as shown on the plat dated November 9, 2009, marked Exhibit "A", attached hereto and incorporated herein by reference, together with the following rights: Grantee shall have unrestricted ingress and egress to the above-described easement and rightTof-way for any purpose necessary far the surveying, construction, inspection, maintenance, repair, replacement, relocation, extension, removal, and operation of such overhead and underground electric utilities and appurtenances. Such rights of ingress and egress shall be exercised in a reasonable manner. Grantor consents to the approval of the proposed construction of electrical transmission lines and appurtenances by the Nebraska Power Review Board and Nebraska Public Service Commission, without hearing, and waives any and all notice of this matter before those twa regulatory bodies. The Grantee agrees to pay the Grantor or Lessee, as their interests may appear, for any damage to personal property, fences, livestock, and growing crops caused by the survey and original construction of the Grantee's electric transmission line. The Grantee agrees to take all reasonable steps to restore, as nearly as possible to the condition it was in prior to construction, any land which is damaged as a result of said construction. Final payment shall be made on or before 60 days after completion of the original construction. The Grantee agrees to pay the Grantor or Lessee, as their interests may appear, for any damage to personal property, fences, livestock, and growing crops and to take all reasonable steps to restore any land which is damaged after the original construction of the Grantee's electric transmission line resulting from the survey, operation, maintenance, inspection, repair, removal, alteration, relocation and reconstruction of the Grantee's electric transmission line. It is further agreed that all claims for such damages must be submitted to the Grantee in writing within 90 days of such occurrence; otherwise, it is agreed that said claim for damages shall have been waived.
