201002140 Ochsner intends to retain and which he intends shall be excluded from this Renunciation and Disclaimer Agreement (the "Retained Assets"), to-wit: (a) All of the Decedent, Jack S. Ochsner's 5.7471% membership interest in MAKO, LLC, a Nebraska limited liability company, and (b) All of the Decedent, Jack S. Ochsner's interest in RBC Liberty Life Insurance Company Policy No. 005405799 insuring the life of Tracy A. Ochsner. 3. As a result of this renunciation and disclaimer and pursuant to the provisions of ARTICLE IX, Paragraph B., of the aforesaid Jack S. Ochsner Revocable Living Trust Agreement dated July 10, 2003, all assets (except the Retained Assets described hereinabove) that would otherwise have been distributed to said Tracy A. Ochsner pursuant to the provisions of ARTICLE IX, Paragraph B. of said Jack S. Ochsner Revocable Living Trust dated July 10, 2003 shall instead be allocated equally to the Jarrett Jackson Ochsner Trust, the Jaden Marie Ochsner Trust and the Jenna Jill Ochsner Trust to beheld, administered and distributed pursuant to the provisions of ARTICLE IX, Paragraph B.4. of the Jack S. Ochsner Revocable Living Trust Agreement dated July 10, 2003. 4. Mr. Bruce I. Smith, with the law firm of Leininger, Smith, Johnson, Baack, Placzek & Allen, attorney for Marie M. Ochsner, Personal Representative of the Estate of Jack S. Ochsner, Deceased, and attorney for Marie M. Ochsner and Tracy A. Ochsner, Co-Trustees of the Jack S. Ochsner Revocable Living Trust Agreement dated July 10, 2003, is instructed to file, mail, or otherwise cause to be delivered to the following persons or entities a fully executed duplicate original copy of this document to-wit: (a) To the County Court of Adams County, Nebraska, c/o Tom Hawes, Clerk Magistrate, P.O.
