201002140 WHEREAS, the undersigned Tracy A. Ochsner, acknowledges that he is releasing something which might be of substantial value to him but he does not expect to nor has he received any consideration in money or otherwise for the execution of this document; WHEREAS, the undersigned, Tracy A. Ochsner, does not expect to nor has he controlled, directed or selected the persons or entities who shall receive, possess and enjoy the interests hereby renounced or disclaimed; and WHEREAS, the undersigned, Tracy A. Ochsner, has not accepted any interest in the property which is subject to this renunciation and disclaimer or any benefits therefrom, he has made no transfer thereof, he has accepted no delivery of such interest in such property, he has exerted no dominion of any kind over such property, and such property has neither been sold nor disposed of otherwise pursuant to judicial process heretofore. RENUNCIATION AND DISCLAIMER 1. The foregoing Introduction and Recitals aze incorporated herein and made a material pazt hereof. 2. The undersigned, Tracy A. Ochsner, does hereby irrevocably and without qualification renounce and disclaim, pursuant to and under the provisions of Nebraska Revised Statutes, Section 30-2352, and of the Internal Revenue Code, Sections 2518 and 2046, any and all beneficial interest granted to him pursuant to ARTICLE IX, Paragraph B., of the Family Trust created by the Jack S. Ochsner Revocable Living Trust Agreement dated July 10, 2003, and any and all beneficial interest in and to all assets allocated to and comprising said Family Trust and all income in connection therewith, except as to the following assets which said Tracy A. 4
