<br />EASEMENT AND RIGHT-OF-WAY
<br />KNOW ALL MEN BY THESE PRESENTS, that LAMAR SCHMIDT and VERNE"1'A
<br />SCHMIDT, Husband and Wife, and TIMOTHY A. SCHMIDT and LYNSE SCHMIDT,
<br />Husband and Wife, hereinafter referred to as "GRANTORS", for valuable consideration, receipt
<br />of which is hereby acknowledged, do hereby give grant and convey unto the VILLAGE OF
<br />ALDA, NEBRASKA, a municipal corporation, "GRANTEE", a perpetual easement and right-of-
<br />way over, across, under, through and upon the following-described real estate, taTwit:
<br />A tract of land in Powell Second Subdivision in the Southeast Quarter (SE 1 /4)
<br />Section Thirty-Two (32), Township Eleven (11) North, Range Ten (10) West of
<br />the 6th P.M., Hall County, Nebraska, more particularly described as follows:
<br />Commencing at the Southwest Corner said Powell Second Subdivision and Place
<br />of Beginning, thence N00°04'22"E (assumed bearing) along the west line said
<br />Powell Second Subdivision a distance of S 13.76 feet; thence N00° 11'43"W
<br />along the west line said Powell Second Subdivision a distance of 165.27 feet;
<br />thence N25°S9'37"E a distance of 53.76 feet; thence N00°04'03"W a distance of
<br />87.89 feet to the north line of Powell Second Subdivision; thence S87°33' 17"E
<br />along said earth line a distance of 198.53 feet; thence S00°05'S7"W a distance of
<br />52.05 feet; thence N64°08'S8"W a distance of SS.40 feet; thence N87°33' 17"W a

<br />Said easement includes, but is eat limited to, the right to install, construct, maintain, replace and
<br />operate a water line ar lines by the GRANTEE within the described easement area in connection
<br />with its public water supply system. It is further provided that said easement shall be deemed to
<br />provide GRANTEE with the right of unrestricted access to its water line or lines by ingress and
<br />egress over, across, through and under the lands herein described, together with all rights of
<br />ingress and egress necessary for the full and complete use, occupation and enjoyment of the
<br />easement hereby granted, including the right to excavate and refill ditches and trenches for the
<br />location of said municipal water line or lines and appurtenant structures related thereto.
<br />In addition to the perpetual easement hereinabove granted, GRANTORS, for the purpose
<br />of permitting initial construction, stockpiling of materials, parking of equipment and
<br />encroachment necessary to initially install pipes and related equipment for such water line, grant
<br />and convey unto GRANTEE a temporary construction easement ("Temporary Easement") over,
<br />through and across that real estate hereinafter described as:
