M ~~ ~ ~ ,. <br />~j 201001588 <br />. ~. , <br />will, within 60 days of closing said sale, pay 2S% thereof to David C. Davis, providing he <br />survives to date of distribution. <br />31. The parties agree with respect to all properties and debts of this marriage to sign any <br />and all papers, titles, or other documents necessary to complete the exchange of property and to <br />carry out this agreement. <br />32. The parties agree that neither party shall pay alimony/spousal support to the other. <br />Both parties acknowledge that they have been advised and understand that unless alimony is <br />awarded in the proceedings presently before the court, the decree of dissolution of marriage <br />cannot subsequently be modified at any time to include an award of alimony to either party. <br />a. The parties agree that this agreement is intended by both of them to be a complete, <br />final and permanent settlement of all property, support and other financial rights, obligations, <br />interests and claims of every kind and nature arising from and in connection with or related to <br />the marital relationship. <br />b. Zn that regard, the wife represents that she has been and continues to be in good health, <br />that she has been and continues to be capable of gainful employment and that she is presently <br />self supporting and expects to remain so. Accordingly, the wife expressly waives all claims, if <br />any, for past, present and future support payments from the husband. <br />c. Likewise, the husband represents that he has been and continues to be receiving <br />government disability and further he has been and continues to be capable of some gainful <br />employment and that he is presently self-supporting and expects to remain so. Accordingly, the <br />husband expressly waives all claims, if any, for past, present and future support payments from <br />the wife. <br />33. The costs of this action and attorney's fees have been paid in full, each party paying <br />one-half. <br />34. The parties agree that this stipulation and property settlement agreement shall be <br />effective only in the event the court enters a decree dissolving their marriage. If such decree is <br />not entered by the court, then this agreement shall be null, void and of no force or effect, <br />35. The parties, in signing this stipulation and property settlement, state that they have <br />read it, understand it and have received a copy of it. The parties acknowledge that this <br />stipulation and property settlement is subject to the approval of the court and is subject to <br />modification by the court at the final hearing. <br /> <br />
