~0~.001483 <br />4.2 Vegetation. To not allow noxious weeds to go to seed; to destroy noxious weeds, as needed; <br />to cut all weeds, sprouts and brush in fence rows and along roads adjoining said Property; to accept , <br />responsibility, and the cost thereof, far eradication of noxious weed infestation; to spray for noxious weeds <br />on a date or dates recommended by the local county extension agent; and if Lessee fails to spray within <br />ten (10) days of the recommended date, to accept responsibility for any and all costs incurred by Lessor in <br />spraying; to pay any fines levied as a result of the presence of noxious weeds on the Property; to not cut <br />live trees for sale ar personal use; to protect the roots of any trees growing in the fields or near any fence <br />by leaving a space around the trees while plowing. <br />4.3 Conservation. To control soil erosion as completely as practicable; to keep in good repair all <br />terraces, open ditches, onlets and outlets of the drains; to preserve all established watercourses or ditches, <br />including grassed waterways; to refrain from any operation or practice that will injure such structures; to <br />exercise due care to insure water runoff does not adversely affect neighbors; to adopt a soil conservation <br />program based on a conservation plan as developed by the local natural resources district; that failure of <br />the Lessee to utilize the Property for agricultural purposes or failure to observe and carry out soil <br />conservation requirements as provided in the rules and regulations of the local natural resources district, <br />department, commission, or board, shall be cause for cancellation of this Lease. <br />4.4 Addition of improvements. To not erect or permit to be erected upon said Property, any <br />structure, building, fence, or sign of any kind whatsoever, except by the written consent of the Lessor and <br />will not make a claim for labor at any time unless Lessor has given written permission at a previous date; to <br />not add electrical wiring without written permission of the Lessor, and when same is given, such wiring <br />shall be inspected and approved by the local power company; and that said wiring shall immediately <br />become part of the Property against which the Lessee will have no further claim. <br />4.5 Damages. Lessee shall be responsible for, and pay far, any damages to the Property from <br />causes in the Lessee's control and that ordinary wear and depreciation or damages outside the control of <br />the Lessee are excepted. <br />4.6 Agricultural Programs.. To consult with the Lessor about, and abide by Lessor's decision in <br />reference to, compliance with the U.S. Department of Agriculture ("USDA") program participation; to follow <br />the USDA Natural Resources Conservation Service recommendations and fulfill all other requirements <br />necessary to maintain the rights of current and future operators of this Property for farm use; to participate <br />in federal farm programs; and to report planted acreages of crops as required by the USDA, Farm Service <br />Agency. <br />4.7 Storage and Use of Herbicides, Pesticides and Fertilizers. To store and use herbicides, <br />pesticides, fertilizers, and other chemicals, and dispose of herbicides, pesticides, fertilizers, and other <br />chemicals containers in accordance with state and federal regulations and recommendations ;and to <br />furnish the Lessor a written field by field record of the amount, kinds, and dates of applications of <br />herbicides, pesticides and fertilizers submitted along with the December payment each year for the Term <br />of this Lease. <br />4.8 Storage of Hazardous Chemicals. To not store motor vehicles, tractors, fuel, and chemicals <br />on the Property in violation of those certain restrictions in the Lessor's insurance policies. <br />4.9 Yielding Possession at End of lease. To yield possession of the Property to the Lessor <br />without further notice at the Expiration Date of this Lease. <br />5. Insurance. Lessee shall provide certification it has obtained all the insurance required hereunder and <br />such insurance has been approved by the Lessor. Approval of the insurance by the Lessor does not relieve or <br />decrease the liability of the Lessee hereunder. If by the terms of any insurance a mandatory deductible is <br />required, or if Lessee elects to increase the mandatory deductible amount, Lessee shall be responsible for <br />payment of the amount of the deductible in the event of a paid claim.
