No term, <br />coveenant, condition or provision of this Lease binding upon the <br />Sublessee, and no breach thereof shall be waived, altered or <br />modified, except by written instrument executed by the Sublessor. <br />Na waiver of any breach shall afr"ect or alter this Sublease, but <br />every term, covenant, condition and provision of this Lease shall <br />continue in full force and effect with respect to any other than <br />existing or subsequent breach thereof. <br />ARTICLE IX <br />MISCELLANEOUS <br />Section 9.1 It is understood and agreed between the parties <br />that time i ~ the essence as to the payment of the monthly <br />rent. <br />Section 9.2 The Sublessee agrees that it will use and <br />occupy the Project in a careful, safe and proper manner, and will <br />rot commit or suffer any waste thereon. Further, the Sublessee <br />agrees that it will obey and follow all laws of the State of <br />Nebraska and of the Ordinances of the City of Grand Island <br />regulating its use of said Project. <br />Section 9.3 The Sublessee shall duly comply with all the <br />provisions of t e Lease and Agreement executed by and between the <br />County of Hall, Nebraska, as Lessor and the Sublessor, and shall <br />further duly comply with all the terms of any Indenture of trust <br />and mortgage to which this Sublease is subordinate, which are to <br />be observed or performed during the term hereof. <br />Section 9.4 The Sublessee shall execute a guarantee <br />agreement with the Sublessor to the County of Haii, Nebraska, and <br />The Overland National Hank of Grand Island. <br />Section 9.5 The Sublessor herein covenants and represents <br />that it i~ s tiFe authority and consent of the Lessor, County of <br />Hall, to enter into and execute this Sublease with the Sublessee. <br />Section 9.6 This Sublease Agreement shall be binding upon <br />and inure to t e benefit of the heirs, executors, administrators, <br />legal representatives, successors and assigns of the Sublessee <br />and the Sublessor. <br />-9- <br />~ - <br />
