Section 404. Prerequisites of Payments from Construction Fund. Payments from the Construction Fund shall be made by tie Trustee upon the order of the Issuer in accordance with the provisions of th_s Section, but no such payment shall be made unless and until the Trustee shall receive a requisition, prepared and signed by the Project r.anager designated by the Sublessee, stating: (a) the item number of each such payment; (b) the name of the person, firm or corporation to whom each such payment is due; (c) the respective amounts to be paid; (d) the purpose by general classification for which each obligation to be paid was incurred; (e) that obligations in the stated amounts have been incurred in connection with the Project and are presently due and payable and that each item thereof is a proper charge against the Construction Fund and has not been paid; (f) that there has not been filed with or served upon the Issuer, the Company or the Sublessee notice of any lien, right to lien or attachment upon, or claim affecting the right of any such persons, firms or corporations to receive payment of, the respective amounts stated in such requisition which has not been released or will not be released simultaneously with the payment of such obligation; and (q} that such requisition eantains no item represent- ing payment on account of any retained percentage which the Issuer is at the date of such req~istiori entitled to retain, unless- payment of each retained percentage shall be approved by the Issuer. Upon receipt of each requisition the Trustee shall withdraw from the Construction Fund an amount equal to the total of the amounts to be paid as set forth in such requisition which shall be paid by check drawn on the Canstruction Fund. The Trustee shall make remittance directly to the payees named in such requisitions, except in those instances where the Company or the Sublessee is being reimbursed for having made such payments directly. 40 I t..
