<br />Declarant as provided in r_he By-Laws. The
<br />Declarant Member or their successor shall be
<br />entitled to three (3) votes for each Lot owned.
<br />The Declarant Membership shall cease and be
<br />converted to Resident Membership upon the
<br />earlier to occur of the following events, to
<br />wit: (1) when the total votes outstanding of
<br />Resident Membership equal the total votes
<br />outstanding in the Declarant Membership, or
<br />(2) on July 1, 1484.
<br />ARTICLE IV
<br />COVENANT FOR MAINTENANCE ASSESSMENTS
<br />Section 1. Creation of the Lien and Personal Obli ation

<br />ropert es ereby covenants, and each Owner of any Lot by
<br />acceptance of a deed therefor, whether or not it shall be so
<br />expressed in such deed, is deemed to covenant and agree to pay
<br />to the Association: (1) Regular annual maintenance assessments
<br />or charges for the purposes hereinafter set forth in Section 2
<br />hereof, (2) Regular assessments for insurance on Properties,
<br />and (3) Assessments for cagital improvements, such assessments
<br />to be established and collected as hereinafter provided. Such
<br />regular and special assessments, together with interest, costs
<br />and reasonable attorney's fees, shall be and constitute, from the
<br />date levied until paid, a continuing charge against and lien upan
<br />such Lot or property against which each such assessment is made,
<br />without any requirement of recording further notice of such lien.
<br />Each such assessment, together with interest, costs, and reason-
<br />able attorney"s fees, shall also be the personal obligation of
<br />each person who was an Owner of such Lot at the time when the
<br />assessment fell due. The personal obligation for delinquent
<br />assessments shall not pass to successor Owners unless expressly
<br />assumed by them.
<br />Section 2. P~ur o~se of Assessments. The assessments

<br />part of the net earnings inuring to the private benefit of it's
<br />members, to promote and sustain their social welfare and other-
<br />wise provide for their heal z.", pleasure, recreation, safety,
<br />and other nonprofitable interests by acquiring, maintaining,
<br />ogaratiag. contributing to the acquiaitian, maintenance, or oper-
<br />ation of. or otherwiaa making-available for use any one or more
<br />area entrances or entry structures, and any other recreational
<br />equipsent, facilities, grounds, or structures, to provide weed and
<br />other actual or potential nuisance abatement or control, security
<br />service, and other comisunity services, to provide for snow removal
<br />on the driveways, parking spaces located on private property and
<br />public and private sidewalks in the subdivision; to provide for the
<br />xemoval of garbage and trash from the subdivision; to mow, seed,
<br />reseed, fertilize and care for the lawns in the Common Area; to
<br />provide for exterior maintenance on the homes located on the
<br />Properties, to provide arehitectural.control and secure compliance
<br />with or enforcement of applicable covenants, easements, restrictions;
<br />and similar limitations, and to undertake such other activities
<br />appropriate, convenient or necessary to promote or sustain any
<br />such itttereet. The exterior maintenance shall consist of exterior
<br />maintenance upon each Lot which is subject to assessment for
<br />exterior maintexwnca hereunder, including but not in limitation
<br />of the following, the painting, repair, replacement and care of
<br />roofs., gutters, downspouts, exterior building surfaces, trees, shrubs,
<br />grass., iial_ks. driveways and private drives and private roads, and
<br />oti~ez ia~rwements. Exterior maintenance shall not include repair,
<br />replacement and care of glees surfaces, doors, garage doors,
<br />a~sChaaical garage doer. openers or any mechanical equipment such
<br />as air- cond$tioning condensers and related appliances and equipment.
