<br /> <br />Section 5. "Lot" shall mean and refer to any platted <br />lot of lance-upon the recorded subdivision mag of the <br />Properties with the exception of the Common Area. <br />Section 6. "Declarant" shall mean and refer to Harry <br />C. Stalker,, a~c~'a P. Stalker, Charles E. Fox, and Mary Fox, <br />and their successors and assigns to the extent that the original <br />Declaration shall specifically designate them as Declarant <br />and such transfer shall comply with the provisions of Article IIi <br />of the By-Laws regulating transfer of Declarant Membership. <br />ARTICLE ZI <br />PROPERTY' RIGHTS <br />Section 1. Owner's Easements of En'o ant. Every <br />Owner sha1L aTi ve and t ere is ere y grante to a Owners a <br />right and easement or enjoyment in and to the Common Area located <br />as above described within the Properties which easement shall <br />be agpurtenant to and shall pass with the title to every Lot, <br />subject to the right of the Association to suspend the voting <br />rights and right to use of the recreational facilities by an <br />Owner for any period during which any assessment against his Lot <br />remains unpaid. The association shall have the right to dedicate <br />or transfer any or all parts of the Common Area to any public <br />agency, authority or utility for such purposes and subject to <br />such conditions as may be agreed to by the members; provided that <br />no such dedication shall be effective unless approved by two-thirds <br />of each class of members of the association as recorded. <br />Section 2. Dale ation of Use. Any Owner may delegate <br />his right o en oyment to t e ommon ea and facilities to the <br />members of his family, guests or tenants; provided, however, <br />that said Owner shall be responsible to the Association for the <br />conduct upon and use by said family, guests or tenants of the <br />Common Area. <br />Section 3. Parkin S aces. Ownership of each Lat <br />shall emit eTt~e owner or owners t ereof to the use of not more <br />than two automobile parking spaces, which shall be as near and <br />convenient to said Lot as reasonably gossible, together with the <br />right of ingress and egress in and upon said parking area. The <br />Association shall permanently assign two vehicle parking spaces <br />to each dwelling unit. <br />ARTICLE YII <br />MEMBERSHIP AND VOTING RIGHTS <br />Section 1. Every Owner of a Lot within the Properties <br />shall be a m~em er of the Association. Membership shall be <br />appurtenant to and may not be separated from ownership of any <br />Lot which is subject to assessment. <br />Section 2. The Association shall have two classes <br />of voting ~ersTi'ipa . <br />(a) "Resident Members" shall be all Owners <br />with the exception of the Declarant and each <br />(3wmer shall be entitled to one vote for each <br />Lot owned.. When more than one person holds an <br />interest in any Lot, all such persons shall be <br />members. The vote for such Lot shall be exercised <br />as trey among themselves determine, but in no <br />avant shall more than one vote be cast with respect <br />to any Lot. <br />(b) "Declarant. Member" shall be the <br />Declarant and their assigns, provided said assign- <br />ment, grant or conveyance to said assigns <br />-2- <br />
