~I~~ <br />INSTRLLM€t1T SRl.E CONTRACT <br />This Contract, made a d entered into this day of <br />481, by and between LouiJ. Raschynialski, a single person, here- <br />inafter referred to as "Seller", and Glen Dale Muhlbach and Sheryl <br />Jean Muhibach, husband and wife, hereinafter referred to as "Buyer", <br />witnesseth: <br />1. Sale. Seller agrees to sell and convey to the Buyers <br />and the Buyers agree to purchase t.".e following described real <br />property in Hall County, Nebraska: <br />Lot One (1) in 3iock Two (2) in Gosda Subdivision, <br />part of the Southeast Quarter of the Northeast Quarter <br />(SE's€4) of Section 23, Township 11 North, Range 10 West <br />of the 6th P.~4. itt Hall County, Nebraska. <br />together with ail improvements and appurtenances thereto belong- <br />ing including the following personal property located therein: <br />dishwasher. <br />2. Purchase Price: The purchase price for the above- <br />described rea and personal property is the sum of Fifty-seven <br />thousand dollars ($57,000.00}, payable as follows: <br />a. Seller hereby acknowledges receipt of Seven <br />thousand dollars ($7,000.00} as initial pay- <br />ment on the purchase price of this Contract. <br />b. The balance of $ 50,000.00 with interest at <br />ten percent (10%) per annum shalt be payable in <br />monthly installments, amortized over a thirty <br />year period, which monthly payment shall in- <br />clude principal and interest, with the first <br />payment to be made on the first day of December <br />1481, and an identical amount on the first day <br />of each month thereafter, The payment shall <br />be $438.79. <br />"~. Possession. Buyers shall have possession of said property <br />upon the exe~vtian of this Contract and payment of the initial <br />payment on or before the 28th day of October, 1981, <br />a. It is further agreed between the Buyers and <br />Seller that Seller shall have the exclusive <br />use of the barn fora period of six months <br />after execution of this agreement. <br />4. Taxes. The Seller agrees to pay the 1980 and all prior <br />years real estate taxes and the 1981 real estate taxes shall be prorated <br />to the date of settlement based upon the 1480. taxes, <br />5. Conve ance and Marketable Title. Seller agrees to <br />furnish the uyers w~ a current extehded Rhstract of Title <br />showing him to. be the owner of a good and sufficient marketable <br />title to the above property, free and clear of liens. Seller <br />agrees. to convey the above property by Warranty Deed and to pay <br />for the-expense of documentary stamps and-the Seller will pay <br />for the- extension of an Rbstract of Title, extended to date, <br />shEnrng marketable t9t_1e, and in the-event the title examin- <br />atian reveals any valid-title objections, the Se17er shall have <br />a reasonati.le time to correct such defects and in the event the <br />s conndt be corrected:,.a11 payments made hereunder shall be <br />refunded to the-Buyers. Buyers have the. option of waiving. any <br />defect in title and accepting the same in such Condition. <br />
