~~~~, <br />AGREEMEN"~" POR TEIE ~Ae.E OF REIiL t'S?"A'T~E <br />THIS ~iGREE~fENT made this 19th day of October, 1381, between <br />Mid-Continent Enterprises, Inc., A Nebraska Corporation, hereinafter <br />referred to as Sellers, and Cecil R. Holloway and Lila C. Holloway, <br />Husband and Wife, hereinafter referred to as Buyers, enter into <br />this agreement for the following described real estate, to-wit: <br />Suite No. Twenty {20), "C" Windsor Square <br />Condominium Property Regime in IInit Three <br />(3), Lot Two {2), Block Eight (8), Replat <br />Continental Gardens, an Addition to the <br />City of Grand Island, Ball County, Nebraska <br />Together with all appurtenances thereto belonging and now <br />thereon far which the Buyer covenants and agrees to pay the <br />total amount of Thirty Three thousand five hundred dollars <br />($33,5.00.00} for said premises to Mid-Continent Enterprises, <br />Inc., A Nebraska Corporation, upon the following conditions <br />and amounts herein set forth. <br />1. The amount of Two thousand dollars ($2,OOG.00}, cash <br />in hand, paid this date, receipt whereof hereby acknowledged. <br />2. The amount of $400.00 shall he paid to Mid-Continent <br />Enterprises, Inc., as rent, <br />The parties further agree that on October 1st, 1983,the <br />Buyer may elect to pay the unpaid balance on the premises in <br />on lump sum, conditional upon Buyer's ability to obtain a loan, <br />to be secured by a first mortgage on the above described <br />property. If the Buy_ar acts in good faith in obtaining a <br />loan, and is refused by an appropriate lending institution <br />then the Buyer shall, upon written showing of the said refusal, <br />be entitled to receive from the Sellers, one-half of the Two <br />Thousand ($2,000.00) down payment and one-half of the One <br />Hundred Dollar ($100.00) payments paid to date. <br />Provided further, that if the Buyer should elect not to <br />make the application for a Loan on the premises or fails to <br />act in good faith, then the Buyer shall forfeit all proceeds <br />paid to the Sellers as of that date, and this contract shall be <br />null and void. <br />
