7 That liens pur~rting to be "`coamctn law liens" were flied by the respondent lienors with the respondent registers of deeds in their respective counties upon real estate oKned by public officials and others xd+ich real estate was never in the possession of the respondent lienors at the time they filed the liens. The basis for these liens was alleged damages for alleged violations of the rights of the respondent lienors. That the purported "common Saw liens" so filed against real property by the respondent lienors are invalid, null and ~~oid ab initia with no force or effect under the taws of the State of Nebraska. The improvident firing of such "common law liens" against real property himier3 and obstructs the personal security of citizens of this state and the reliability of the official books and records kept by the registers of deeds and county clerks in their respective counties. The public confidence in such records is eroded by the filing of invalid instruments affecting real property and is injurious to the integrity of the legal system. the r~eifare of the citiaenry, and the public con#idence in public records. The filing of such invalid "common law liens" can affect the performance of duty of th€ public officials against whom such liens may be filed in the future.
