~. <br />That liens purporting to be "coasnan law liens" were filed by the <br />respor~ent lienors with the respondent registers of deeds in their <br />respective counties upon real estate owned by public officials and others <br />which real estate was never in fire possession of the respondent lienors at <br />th? flare they filed the liens. <br />The basis for these liens was alleged damages for alleged violations of <br />the rights of the respondent lienors. <br />` That the purported "ccxnmon law liens" so filed against real property by <br />the respondent lienors are invalid, null and void ab initio with no force or <br />effect under the laws of the State of Nebraska. <br />The improvident filing of such "common law liens" against real property <br />hinders and obstructs the personal security of citizens of this state and <br />Lhe reliability of the official books and records kept by the registers of <br />deeds and county clerks in their respective counties. The public confidence <br />in sorb records is eroded by the filing of invalid instruments affecting <br />real property an6 is injurious tv the integrity of the legal system, the <br />welfare of the citizenry, arsd the public confidence in public records. <br />The filing of such invalid "common law liens" can affect the <br />performance of duty of the public officials against whom such liens may be <br />filessn Lhe future. <br />There exists a present actual controversy with regard to such purported <br />"coon law liens for which there is ne adequate remedy at law. The <br />relater has a clear right to areva_il and those persons against who liens <br />have men arwf will be filed will suffer irreparable harm try the continued <br />illegal appearance of encua#rance upon their real property. <br />The relator is entitled to judgment as a matter of law upon the <br />evidence before this court. <br />The relator is further entitled to an injunction against the <br />respondents, Margory Y. Blorr~erg, ~?obert E. Blomberg, Jr., Thomas F. <br />F~hring, Donna 5. Nehring, and Larry Jones restraining and prohibiting them <br />and each of them from filing further purported "comeron law liens" purporting <br />~ af~e+«t any re81 property in the State os` i+ieebrasKa and requiring each of <br />tp eute a release for each of the purported "con+a~n lax liens," the <br />suls,~~t of this soft a~ found in the relatar's petition} within ten days of <br />entry of this judgment or to subject themselves to the provisions of <br />l,Rev,Stai. 452-112 (iieissue 14711) and contempt of court. <br />2 <br />
