<br />$~.-~ U~3g~~ <br />such appointment and substitution shall be made by <br />written instrument and executed by Bent-ficiary, <br />containing reference to this Trust Deed and its <br />place of record, which, when recorded in the <br />office of the Register of Deeds of the county or <br />counties in which said property is situated, shall <br />be conclusive proof of proper appointment of the <br />successor Trustee. The foregoing power of substi- <br />tution and the procedure shall not be exc7_usive of <br />the power and procedure provided for by law for <br />the substitution of a Trustee in the place of the <br />Trustee named herein. <br />F. Trustor covenants and agrees that upon any convey- <br />ance, assignment or transfer of his interest in <br />the premises durinr~ the term of the loan secured <br />hereby, the Beneficiary shall have the option of <br />declaring the unpaid balance immediately due and <br />payable, and if said sum remains unpaid for ten <br />(10) days thereafter, Beneficiary can cause Notice <br />of Default to be given and the premises to be sold <br />as provided herein. <br />G. As additional and collateral aecurity for the loan <br />and effective forthwith open filing of a Notice of <br />Default, this instrument small serve as an assign- <br />aEent by the Trustor to the Trustee of all rents <br />and revenues resulting from the property, and <br />Trustee is authorized to take possession of the <br />property, rent or lease the same an terms he deems <br />best and to collect the rents and revenues and <br />apply the same upon unpaid interest, principal, <br />taxes or insurance premiums or for maintenance and <br />preservation of the premises. <br />H. Jpon request of Trustor, Beneficiary, at Benefi- <br />ciary's option, prior to full reconveyance of the <br />property by Trustee to Truster, may make future <br />advances to Truster. Such future advances, with <br />interest thereon, shall bZ. secured by this IIeeci of <br />Trust when evidenced by promissory notes stating <br />that said ;ores are ~r_-cured hereby. At no time <br />shall the orincioal runt of indebtedness secured <br />by this Deed of Trust, not including sums advanced <br />in accordance herewith to protect the security of <br />this Deed of Trust, exceea the original amount of <br />the Note plus US 510,040.40. <br />2. The waiver by Trustee or Beneficiary of any de- <br />fault of Trustor under this Trust Deed shall not <br />be ~r be deemed to be a waiver of any other or <br />similar defaults subsequently occurring. <br />3. The designation "Trustor" herein shall extend to <br />and apply to the undersigned, singular or plural, <br />and the covenants and agreements of the Trustor <br />herein shalt be binding upon his heirs, devisees, <br />executors, administrators, successors, and assigns. <br />K.
