8~~(~u364s <br />AGREEMENT FOR SALE OF REAL ESTATE <br />t <br />THIS AGREEMENT made this ,~3 ra day of April, 1481, by and <br />between r,ARGERY E. MELKUS and LEONARD A. MELKUS, Wife and Husband, <br />SELLERS, and RYCHARD L. MELKUS and SUSAN J. MELKUS, Husband and <br />Wife, as Joint Tenants with right of survivorship, and not as <br />tenants in common, BUYERS. <br />WITNESSETH: That the Sellezs have sold to Buyers for the <br />consideration of Forty-five Thousand Dollars (S45,000.00) on the <br />rarma and condit_i_ons hereinafter mentioned, the following described <br />real estate: <br />The West One-half (W~) of Lot Three {3) in Block One <br />Hundred One (101), Railroad Addition to the City of <br />Grand Island, Hall County, Nebraska: <br />1. TERMS OF PAYMENT. Buyers shall make payments on and for <br />said real estate as follows: <br />a. The sum of Ten Thousand Dollars ($10,000.00),receipt <br />of which is hereby acknowledged. <br />b. The balance of Thirty-five Thousand Dollars (535,000.60D <br />shall be pai~ in monthly installments of Two Hundred <br />Seventy-four & 40/100ths Dollars {527$.40) per month, <br />commencing on April 15, 1981, and continuing on the <br />first aay of each month thereafter, said monthly <br />payments include interest at the rate of 9i per <br />annum computed monthly. Said payments shall <br />continue until `he entire balance of prine ipal <br />and interest is paid in full as per the attached <br />amortization schedule. <br />2. DEED. Sellers shall execute a Warranty Deed conveying <br />said premises to Buyers free and clear of encumbrances and will <br />pay seal estate taxes on said premises for 1980 and all prior <br />years. Real estate taxes for 1981 shall be pro-rated to date <br />of possession. <br />3. POSSESSION. Buyers shall have possession of said <br />premises on April 1, 1981. <br />4. INSURAYiCE. Buyers shall maintain insurance on said <br />premises in an amount at least equal to the unpaid balance of <br />principal and interest, <br />5. REPAIR. Sellers agree to install a new furnace and <br />roof at their expense. <br />~. ESCROW. The executed Warranty Deed shall be placed <br />in escrow with the law firm of Brogan, McCloskey ~ Wolstenholm, <br />York, Nebraska, to be delivered to Buyers upon completion of the <br />terms of this Agreement. <br />7, DOCt~IEHTARY TAX. Sellers agree to pay the amount required <br />for the payment of documentary tax on this transaction at the time <br />of delivery of the Warranty Deed to Buyezs when Buyers have <br />performed the terms and conditions of this Agreement. <br />8. ASSiGiiMBNT. Buyers shall not assign or sell their interest <br />under this Agreement without the written consent of Sellers duriag <br />the term of this Agreement. <br />
