Hardy and their successors and assigns <br />to the extent that the original Declarant shall specifically <br />designate them as Declarant and such transfer shall comply-wth- <br />the provisions of Article IIT of the By-Laws regulating trafer <br />of Declarant Membership. <br />ARTICLE II <br />PROPERTY RIGHTS <br />Section 1. Owner's Easements of Enjoyment. The association shall have the right to dedicate. <br />or transfer any or all parts of the Common Area to any public <br />agency, authority or utility far such purposes and subject to <br />such conditions as may be agreed to by the members; provided that <br />nn such dedication shall be effective unless approved by twa-thirds <br />of each class of members of the association as recorded. <br />Section 2. Delegation of Use. Any Owner may delegate <br />his right o en oyment to tTie-mammon Area and facilities to tYee <br />members of his family,. guests or tenants; provided, however,. <br />that said Owns- shall be responsible to the Association for the <br />conduct upon and use by said family, guests or tenants of the <br />Common Area. <br />Section 3. Parking Spaces. Ownership of each Lot <br />shall emit e_I'- t~ owner or owners t~iereof to the use of not more <br />than two automobile Barking spaces, which shall be as near and <br />convenient to said Lot as reasonably possible, together with the <br />right of ingress and egress in and upon said parking area. The <br />Association shall permanently assign two vehicle parking spaces <br />to each. dwelling unit. <br />ARTICLE ZII <br />ME*SBERSHIF AND VOTING RIGHTS <br />Section i. Every Owner of a Lot within the Properties <br />shall be a me er of the Association. Membership shall be <br />appurtenant to and may not be separated from ownership of any <br />Lot which is subject to assessment. <br />Seetion 2. The Association shall have two classes of <br />voting me ers ps. <br />(a) "Resident Members" shall be all Owners <br />with the exception of the Declarant and each <br />Owner shall be entitled to one vote for each <br />Lot awned. When more than one person holds an <br />interest in any Lot, all such persons shall be <br />members. The vote for such Lot shall be exercised <br />as they among themselves determine, but in no <br />event shall ire than one vote be cast with respect <br />to any Lot. <br />(ts) "Declarant ";embers" shall be the <br />Declarant and their assigns, provided said <br />assignment, grant or conveyance to said assigns <br />-2- <br />
