<br />82--OU3276 <br /> <br />h1ASTER REED <br />CREATING <br />FAIRt~AY VILLAS CONDOMINIUM PROPERTY REGIMB II <br />TRIS MASTER DEED AND DECLARATION, made this 23rd d8y of <br />June, 1481, by HELEN GIESENSAGEN therein called "Declarant"3, <br />for herself, her heirs, grantees and asaigna. <br />I. PURPOSE AND NAME. <br />The guspose of this Master Deed is to submit the lands <br />herein described and the improvements built thereon to the <br />condominium form of ownership and use in the manner provided <br />by Sections 76-801 through 76-823, R.R.S. Nebraska- {herei.n <br />called "Condominium Property Aet"), and the name by which <br />this condominium is to be identified is Fairway Villas <br />Condominium Property Regime II. <br />II. INVOLVED PROPERTY. <br />The 1a.~ds owned by the Declarant which are hereby <br />suhmitted to the condominium regime are described as follows: <br />See attached Exhibit "A", <br />IIZ. DEFINITIDNS. <br />Except as hereinafter noted, the definitions set forth <br />in Section 76-802, R.R.S. Zebraska shah govern this Master <br />Deed and the By-Laws, attached hereto as Exhibit "8", and by <br />this reference incorporated herein. <br />a_ "'Jilla" shall mean and include: The enclosed <br />space of the five residential living units and enclosed <br />garages shown on Exhibit A hereto and identified thereon as <br />"villas" by number; all airspace in rooms, attics; air <br />conditioning compressors or units; permanent gas, charcoal <br />burning or electric barbecue grills, screening, window <br />glass, exterior and interior doors, but shall not include <br />structural walls, common wails, xnterioz walls, roofs, <br />floors and ceilings, except for the unit-side surfaces <br />thereof, which shall be included in the definition "villa". <br />h. "Condominium" shall mean the entire condo- <br />minium project including all buildings, land, and other <br />improvements upon the land as set forth in this Master Deed <br />as a Bart of the condominium regime. <br />c. "Ger_eral Common Elements" snail include: The <br />Land on which the buildings stand, including all of the <br />surrounding iandr; embraced within the legal description <br />specified in Article IZ above; the foundations, roofs and <br />main walls including the exterior surfaces of all huildings <br />and garages except for screening; window glass, exterior <br />doors and garage doors; and including exterior water taps'' <br />which may be used by the owners Association far watering and <br />maintenance of common areas and yards and gardens; drives; <br />walks; parking area; utility buildings: and all parts of <br />the property anal improvements which are not located within <br />the "Villas" or denoted as "limited common elements" as <br />xhoxn on the plan which is Exhibit C hereto. General common <br />slemsnta shall also include all installations and the space <br />necessary therefor of all central services to be provided up <br />to esch suite ar garage including electric wiring, plumbing, <br />t+al~phone wiring and flues. <br />_i~ <br />
